HomeMy WebLinkAbout1973-04-18; Municipal Water District; Resolution 296RESOLUTION NO. 296 RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT APPROVImG RULES AND REGULATIONS OF CARLSBAD MUNICIPAL WATER DISTRICT ON WATER SERVICE TO "CONDOMINIUM"-TYPE DEVELOPMENTS WITHIN CARLSBAD MUNTCIPAL WATER DISTRICT. WHEREAS, Ordinance 26 of CARLSBAD MUNICIPAL WATER DISTRICT, provides in part as follows: Section 2. The Manager of the District may make, from time to time, rules and regulations, not in conflict with this Ordinance or other ordinances of the District, governing the use and consumption of water, subject to the approval of the Board; and all consumers shall observe such rules and regu- lations to the same extent as though set forth in this Ordinance; and WHEREAS, the Manager has made and caused to be made, I written rules and regulations concerning Water Service to "Condominium"-type developments ; and WHEREAS, the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT, desires to approve such rules and regulations. NOW,THEREFORE, the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT does hereby resolve as follows: 1. The written rules and regulations, entitled "WATER SERVICE TO "CONDOMINIUM"-TYPE DEVELOPMENTS" are hereby approved. 2. All consumers of CARLSBAD MUNICIPAL WATER DISTRICT shall observe such rules and regulations as the same may be appli- cable to any water service to "Condominium"-type developments with- I in CARLSBAD MUNICIPAL WATER DISTRICT. ABSENT : Kelly -3- RULES AND REGULATIONS OF CARLSBAD MUNICIPAL WATER DISTRICT WATER SERVICE TO "CONDOMINIUM" - TYPE DEVELOPMENTS RESOLUTION NO. 296 APRIL 18, 1973 I. Introduction: Under the guidelines of Ordinance No. 26 of the Carlsbad Municipal Water District it is the responsibility of the General Manager to develop practical rules and regulations regarding water service. The subject of this report deals with the special condition of water service to conddminium types of development within our District. Inasmuch as condominium types of development are unique and the District has had the benefit of a number of years experience in dealing with these types of developments it is appropriate that our rules and regulations be established in a more formal manner so that our aims and goals will be better understood and interpreted by developers and other interested parties. 11. Definition of Terms: In order to establish certain rules and regulations it is necessary to identify definitions of terminology as it applies to specific developments. The following are common terms which should be set forth in specifics: A. Pub1i.c Water System: The public water system consists of a water main, gate valve, water service, water meter, and other appurtenant facilities that are constructed to the standards of this District and are owned and operated by this District. B. Single Family Dwelling Unit: A single family dwelling unit comprises the essential functional parts of a living unit, which would include a living room, kitchen area, bathroom facilities, bedrooms and such appurtenances to accomodate a conventional family unit. The single family unit does not include those units that are multi-structured. A typical definition of a single family unit is that type of development that is permitted on a single family residential lot or a single family living unit that is attached to other single family living units by common walls in which case there may be two or more single family units interconnected by common walls. C. Condomi ni um Type Devel opment: For the purposes of this report a condominium refers only to the manner in which the living unit is acquired for ownership purposes and does not relate to the actual type of structure that is being constructed. D. Multiple Type Residential Dwelling Units: A multiple residential dwelling unit structure consists of two or more family living units which are located within a single structure and multi-storied in character and includes a "tower" type of development. 111. Conditions For Providing Public W,ater Service To The Living Units: A. Case No. 1: In the event the development contains single family dwelling units interconnected with other single family dwelling units by common walls there shall be constructed a public water system within the common area of the development so that an individual water service and individual water meter will be provided for every single family living unit. There are design modifications that can be integrated into the overall plans at such time the engineering construction drawings are prepared. It is important however to recognize that in character there will be provided a public water system to every living unit comparable to a single family residential subdivision. B. Case No. 2: Where there is developed on individual lots multiple story family units there will be a public water system and an individual service and an individual water meter to each lot of.the subdivision which in turn will provide water service to the mu1 tiple story residential structure. .. -2- 5UO El Camino Real, Carlsbad, California 92008 Telephone: (7 14) 729-2348 - - __ - ---- -_ ----- ____ - .- __I-_ _I_ C. Case No. 3: In the case of a residential development involving two or more "tower" type residential developments there will be constructed a public water system in the common area or private street area as necessary so that an individual water service and individual meter will provide water service to each tower complex. IV. Special Development Concepts and Modifications of the Common Water System Layouts: There is a potential for deviations from the rules and regulations as outlined above whenever a design concept is promulgated which will require an individual evaluation and determination. It should be borne in mind that one of the fundamental concepts of public water service which our Board of Directors believe is in the overall interest of the District and its water consumers, involves a capability of this District to provide water service to all of its customers and to have our responsibilities for this important task extended to a reasonable limit so that there are no undue burdens placed upon the water consumer himself. As a corollary to this basic philosophy our District possesses the necessary knowledge, operations and maintenance expertise and an overall organizational capability to fulfill our obligations in areas where condominium-type developments are constructed. We also believe that our posture of public service capability is comparable to that of the other public service utilities that now serve our modern developments. V. Guidelines for the Implementation of Water Service Policy: There follows descriptive plats showning typical examples of the implementation of the District policy as set forth hereinbefore.
