HomeMy WebLinkAbout1973-10-03; Municipal Water District; Resolution 306, RESOLUTION NO. 306 RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT APPROVING RULES AND REGULATIONS OF CARLSBAD MUNICIPAL WATER DISTRICT FOR SERVICES TO PROPOSED DEVELOPMENT PROJECTS WITHIN CARLSBAD MUNICIPAL WATER DISTRICT WHEREAS, Ordinance 26 of CARLSBAD MUNICIPAL WATER DISTRICT provides in part as follows: Section 2. The Manager of the District may make, from time to time, rules and regulations, not in conflict with this Ordinance or other ordinances of the District, governing the use and consumption of water, subject to the appro- val of the Board; and all consumers shall ob- serve such rules and regulations to the same extent as though set forth in this Ordinance; and WHEREAS, the Manager has made and caused to be made, written rules and regulations concerning services to proposed development projects within CARLSBAD MUNICIPAL WATER DISTRICT: and WHEREAS, the Board of Directors of CARLSCAD MUNICIPAL WATER DISTRICT desire to approve such rules and regulations, NOW, THEREFORE, the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT does hereby resolve as follows: 1. The following rules and regulations for ser- vices to proposed development projects within Carlsbad Municipal Water District are approved: a. The District staff and advisors shall pro- vide complete coordination and information service to prospective developers, con- sulting engineers, realtors and other parties who have an interest in land de- velopment within Carlsbad Municipal Water -1- District. The scope of the work on the part of the District under this phase of development is inten- ded to provide basic background data to interested parties, with an em- phasis upon participation by the District staff and coordination with the consultants as necessary. b. As a prospective development project becomes more definitive,requiring response to specific issues and a more concise evaluation and study of more specific issues relating to overall design of the public water system, review of tentative map lay-outs and other specific issues for a specific project, the District will require a deposit to cover the estimated expenses to the District for the more detailed services. A minimum deposit of $200.00 shall be posted. The Manager shall have the sole discretion to determine if a deposit larger than the minimum de- posit should be posted. c. The District will maintain a separate account for each project and provide the party posting the deposit with the full accounting of the District expenses. The District expenses shall include a factor of 15% for overhead -2- STATE OF CALIFORNIA County of San Diego ) ss. .- I, W. D. CARMICHAEL, Secretary of the CARLSBAD MUNICIPAL WATER DISTRICT and of the Board of Directors thereof, do hereby certify that the foregoing Resolution was duly adopted by the Board of Directors of said District at a regular meeting of the said Board held on the 3rd day of October, 1973, and that it was adopted by the following vote : AYES : NOES : ABSENT : Maerkle, Carmichael, Engelmann, MacLeod and Kelly. Any portion of the deposit not ex- pended by the District shall be refunded to the party posting the de- posit. 2. All consumers of CARLSBAD MUNICIPAL WATER DISTRICT shall observe such rules and regula- tions as the same may be applicable to any proposed developments within the CARLSBAD MUNICIPAL WATER DISTRICT.
