RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT
REQUESTING SAN DIEGO COUNTY WATER AUTHORITY
TO ACT AS APPLICANT FOR AN APPLICATION UNDER
LOCAL PUBLIC WORKS CAPITAL DEVELOPMENT
AND INVESTMENT PROGRAM FOR
TRI-AGENCIES WATER TRANSMISSION PIPELINE PROJECT
WHEREAS, SAN DIEGO COUNTY WATER AUTHORITY and three water
agencies, CARLSBAD MUNICIPAL WATER DISTRICT, CITY OF OCEANSIDE
and VISTA IRRIGATION DISTRICT, who receive water from SAN DIEGO
COUNTY WATER AUTHORITY, have jointly investigated and developed a
program to provide an additional water supply for the three water
agencies; and
WHEREAS, it has been determined by the investigation of
all of the parties that the existing water supply system is inade-
quate to serve existing inhabitants and land within the three water
agencies who are now entitled to water; and
WHEREAS, it has been determined that an additional source
of water is necessary for the adequate protection of the inhabitants
and property within the three water agencies to provide sufficient
flows of water for adequate fire protection; and
WHEREAS, it has been determined that the most economically
feasible way to acquire the additional source of adequate water for
the three water agencies is through the development of a joint
water transmission pipeline, which for convenience is referred to
as "TRI-AGENCIES WATER TRANSMISSION PIPELINE" ; and
WHEREAS, it has been determined that

NOW, THEREFORE, THE BOARD OF DIRECTORS OF CARLSBAD MUNI-
CIPAL WATER DISTRICT DOES HEREBY RESOLVE AS FOLLOWS:
1. The CARLSBAD MUNICIPAL WATER DISTRICT respectfully
requests the SAN DIEGO COUNTY WATER AUTHORITY to act as applicant
for an application under LOCAL PUBLIC WORKS CAPITAL DEVELOPMENT
AND INVESTMENT PROGRAM for TRI-AGENCIES WATER TRANSMISSION PIPE-
LINE.
2. The CARLSBAD MUNICIPAL WATER DISTRICT authorizes the
SAN DIEGO COUNTY WATER AUTHORITY to act for and on behalf of the
CARLSBAD MUNICIPAL WATER DISTRICT in reference to any acts con-
nected with an application under LOCAL PUBLIC WORKS CAPITAL DEVELOP-
MENT AND INVESTMENT PROGRAM for TRI-AGENCIES WATER TRANSMISSION
PIPELINE.
3. The CARLSBAD MUNICIPAL WATER DISTRICT hereby agrees to
pay their pro-rata share of any costs connected with the said ap-
plication and project under LOCAL PUBLIC WORKS CAPITAL DEVELOPMENT
AND INVESTMENT PROGRAM, which are not reimbursable by said program.
4. The CARLSBAD MUNICIPAL WATER DISTRICT hereby agrees
that the ownership and operation of TRI-AGENCIES WATER TRANSMISSION
PIPELINE shall be by SAN DIEGO COUNTY WATER AUTHORITY, until and
unless the parties to the said project agree to the contrary.
