HomeMy WebLinkAbout1977-08-17; Municipal Water District; Resolution 366RESOLUTION NO. 366 RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT ON CONSIDERATION OF PROPOSAL OF CITY OF CARLSBAD TO ESTABLISH CALRSBAD MUNICIPAL WATER DISTRICT AS A SUBSIDIARY DISTRICT WHEREAS, the City Council of the City of Carlsbad has requested the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT to consider consenting to the establishment of CARLSBAD MUNICIPAL WATER DISTRICT as a subsidiary district; and WHEREAS, the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT have considered the proposal and evidence presented to it by the City of Carlsbad; and WHEREAS, the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT have conducted a public hearing on June 15, 1977, for which extensive public notice was given, and at which time any person interested in submitting information to assist the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT in analyzing the proposal had an opportunity to be heard; and WHEREAS, the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT have carefully considered all of the evidence, testimony and information that they have received on the proposal. NOW, THEREFORE, THE BOARD OF DIRECTORS OF CARLSBAD MUNI- CIPAL WATER DISTRICT DOES HEREBY RESOLVE AND ORDER AS FOLLOWS: 1. There has not been any information or evidence presented to the Board of Directors of CARLSBAD MUNICIPAL WATER DIS- TRICT that justify the proposal of the City of Carlsbad to establish CARLSBAD MUNICIPAL WATER DISTRICT as a subsidiary district. 2. There has been information received by the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT that it is to the -1- advantage of the taxpayers, voters and water users within the boundaries of CARLSBAD MUNICIPAL WATER DISTRICT for the CARLSBAD MUNICIPAL WATER DISTRICT to continue its existing policies and services. 3. There has been information received by the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT that it would be to the advantage of the taxpayers, voters and water users within the boundaries of CARLSBAD MUNICIPAL WATER DISTRICT for the CARLSBAD MUNICIPAL WATER DISTRICT to be responsible for all water facilities planning and water services within the boundaries of CARLSBAD MUNI- CIPAL WATER DISTRICT. 4. The Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT recognizes under the terms of its relationship with SAN DIEGO COUNTY WATER AUTHORITY and METROPOLITAN WATER DISTRICT it has the responsibility for all water facilities planning and water supply within the boundaries of CARLSBAD MUNICIPAL WATER DISTRICT. 5. The Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT is desirous of offering its cooperation and assistance to the City of Carlsbad in coordinating its water facilities planning, water supply and water service activities with the land use and facilities objectives of the City of Carlsbad. 6. The Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT is willing to accept the responsibility for all water services within the boundaries of CARLSBAD MUNICIPAL WATER DISTRICT. 7. The Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT is willing to offer its cooperation and assitance to the City of Carlsbad in establishing a consolidation of all water services within the boundaries of CARLSBAD MUNICIPAL WATER DISTRICT, under the jurisdiction and management of CARLSBAD MUNICIPAL WATER DISTRICT. -2- 1977. Deposits on Water Usage (1) The General Manager shall have the discretion to cause a deposit for water usage to be made by any type of water user if the General Manager determines it is necessary for the best interests of the District. (2) All Retail - Construction services shall re- quire a $300.00 deposit. c. Delinquency (1) Any water bill unpaid fifteen (15) days after the date of mailing of said water bill shall be deemed delinquent. (2) Any delinquent bill shall be subject to a penalty of ten per cent (10%) of the amount due or the sum of $1.00, whichever is greater. (3) Any connection with a delinquent water bill shall be subject to discontinuance and re- moval until all charges are paid. -4- 1977. d. Reconnection Fee A reconnection of a meter connection shall be subject to the actual cost of such reconnection or the sum of $10.00, whichever is greater.
