HomeMy WebLinkAbout1977-11-16; Municipal Water District; Resolution 367RESOLUTION NO. 367 RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT AMENDING RESOLUTION NO. 363 FIXING THE RATES AND CHARGES OF WATER SUPPLIED BY CARLSBAD MUNICIPAL WATER DISTRICT WHEREAS, the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT adopted Resolution No. 363 on July 15, 1977, fixing the rates and charges of water supplied by CARLSBAD MUNI- CIPAL WATER DISTRICT; and WHEREAS, the Board of Directors desires to amend the said Resolution No. 363 for purposes of clarification and estab- lishment of terms in accordance with the accounting system and reports required for the CARLSBAD MUNICIPAL WATER DISTRICT. NOW, THEREFORE, THE BOARD OF DIRECTORS OF CARLSBAD MUNI- CIPAL WATER DISTRICT DOES HEREBY RESOLVE AS FOLLOWS: 1. The Charge for Type of Use in Resolution No. 363, Paragraph 2, is revoked in its entirety and the following is substituted in its place, in like manner as if the same had been originally incorporated therein: Charge for Type of Use Retail - Residential - Individual None Retail - Residential - ) $2.30 for each dwelling Multiple ) or living unit served Retail - Residential - ) through the same meter. Condominium ) Retail - Mobile Home Parks) Retail - Agricultural None Retail - Industrial None Retail - Business None Retail - Special (Hotels and $1.00 for each living !^5otels, with tran- unit served through the ,•-.lent customers) same meter. Retail - Governmental Agency Facilities Retail -Fire Protection Service Retail - Construction None - unless there is a dwelling or living space on the property, in which case the charge is $2.30 for each dwel- ling or available living space served through the same meter. $8.00 per connection. $30.00 per connection. Definitions Retail - Residential - Individual Retail - Residential - Multiple Any one living unit with an individual meter. More than one living unit served through the same meter. Retail - Residential - Condominium Retail - Mobile Home Parks Retail - Agricultural Retail - Industrial Retail - Business A condominium in accordance with the laws of the State of California, with more than one living unit served through the same meter. More than one living unit or available living space served through the same meter. A user utilizing District water to produce agricul- tural products of whatsoever nature or kind, for sale and pursuant to the regulation Of METROPOLITAN WATER DIS- TRICT and SAN DIEGO COUNTY WATER AUTHORITY wherein water usage qualifies for agricul- tural rebate. A commercial venture that produces a product. A commercial venture which buys or sells items (whole- sale or retail) or provides services for hire. Retail - Soecial Retail - Governmental Agency Facilities Hotels and motels, with transient customers. A facility owned and operated by City, County, State or Federal government. Retail - Fire Protection Service Retail - Construction Any service and meter con- nection installed speci- fically for fire protection service. A temporary service and meter installed for con- struction purposes only. 2. The rates on a monthly basis charged for all retail water delivered by the District in Resolution No. 363, Paragraph 3, is revoked in its entirety and the following is substituted in its place, in like manner as if the same had been originally incorporated therein: Retail - Residential - ) Individual ) Retail - Residential - ) Multiple ) Retail - Residential - ) Condominium ) Retail - Mobile Home Parks ) Retail - Special (Hotels and) Motels, with tran- ) sient customers) ) Retail - Industrial ) Retail - Business ) Retail - Governmental Agency) Facilities ) Retail - Construction ) Retail - Agriculture $0.33 per 100 cubic feet or fraction thereof. $0.22 per 100 cubic feet or fraction thereof. 3. The Retail Water Readings and Billings in Resolution No. 363, Paragraph 5, is revoked in its entirety and the following is substituted in its place, in like manner as if the same had been originally incorporated therein: 5. Retail Water Readings and Billings - a. Type of user Retail - Residential - Individual Bi-Monthly Retail - Residential - ) Multiple ) Retail - Residential - ) Condominium ) Retail - Mobile Home Parks) Retail - Agricultural ) Retail - Business ) Retail - Special (Hotels ) and Motels, with ) Monthly transient cus- ) tomers) ) Retail - Governmental ) Agency Facilities) Retail - Fire Protection ) Service ) Retail - Construction ) In reference to Retail - Residential - Individual, the General Manager shall have the discretion to cause monthly billing if the General Manager deter- mines it is necessary for the best interests of the District. b. Deposits on Water Usage (1) The General Manager shall have the discretion to cause a deposit for water usage to be made by any type of water user if the General Manager determines it is necessary for the best interests of the District. (2) All Retail - Construction services shall re- quire a $300.00 deposit. c. Delinquency (1) Any water bill unpaid fifteen -(15) days after the date of mailing of said water bill shall be deemed delinquent. (2) Any delinquent bill shall be subject to a penalty of ten per cent (10%) of the amount due or the sum of $1.00, whichever is greater. (3) Any connection with a delinquent water bill shall be subject to discontinuance and re- moval until all charges are paid. d. Reconnection Fee A reconnection of a meter connection shall be subject to the actual cost of such reconnection or the sum of $10.00, whichever is greater.
