HomeMy WebLinkAbout1979-06-20; Municipal Water District; Resolution 385RESOLUTION NO. 385 RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT FIXING RATES AND CHARGES OF WATER SUPPLIED BY CARLSBAD MUNICIPAL WATER DISTRICT, EFFECTIVE JULY 1, 1979 WI-IEMAS, Article I11 of Ordinance No. 26 of CARLSBAD MUNICI- PAL WATER DISTRICT provides that the water rates and all charges for all water delivered by CARLSBAD MUNICIPAL WATER DISTRICT shall be fixed and charged by Resolution; and WHEREAS, the existing Resolutions pertaining to rates and charges of CARLSBAD MUNICIPAL WATER DISTRICT is deemed to be inadequate; and - WHEREAS, a special committee of the members of the Board of Directors and members of the staff of CARLSBAD MUNICIPAL WATER DISTRICT carefully investigated the matter and arrived at the conclusion that a revision of the schedule of rates and charges for water delivered which would create a water rate increase would be necessary; and WHEREAS, the said special committee reported the conclusion to the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT; and WHEREAS, a communication was addressed to all water custo- mers of CARLSBAD MUNICIPAL WATER DISTRICT, dated May 4, 1979, advising the water customers of the preliminary evaluations of an adjustment of water charges for the next fiscal year and requesting any comments or questions to assist the Board. of Directors of CARLSBAD MUNICIPAL WATER DISTRICT in determining any adjustment of water charges; and -1- WHEREAS, approximately 3000 communications were delivered to all water customers of CARLSBAD MUNICIPAL WATER DISTRICT; and WHEREAS, 3 responses offering comments to the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT were received and duly considered by the staff, special committee and the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT; and WHEREAS, the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT deems it expedient, proper, necessary and to the best interest of the CARLSBAD MUNICIPAL WATER DISTRICT to revise the schedule of rates and charges for all water delivered. NOW, THEREFORE, THE BOARD OF DIRECTORS OF CARLSBAD MUNICI- PAL WATER DISTRICT DOES HEREBY RESOLVE AS FOLLOWS: 1. The following resolutions of the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT relating to the existing rates and charges of water supplied by CARLSBAD MUNICIPAL WATER DISTRICT: Resolution No. 363, adopted July 15, 1977; Resolution No. 367, adopted November 16, 1977; Resolution No. 380, adopted December 20, 1978; and Resolution No. 382, adopted March 21, 1979 are hereby rescinded and the rates and charges of water supplied by CARLSBAD MUNICIPAL WATER DISTRICT after July 1, 1979 (subject to terms and conditions set forth hereinafter) shall be as hereinafter set forth. 2. Retail - Residential - Multiple More than one living unit served through the same meter. Retail - Residential - Condominium A condominium in accordance with the laws of the State of California, with more than one living unit served through the same meter. Retail - Mobile Home Parks Retail - Agricultural Retail - Industrial Retail - Business Retail - Special Retail - Governmental Agency Facilities More than one living unit or available living space served through the same meter. A user utilizing District water to produce agricultural products of whatsoever nature or kind, for sale and pursuant to the regulations of METROPOLITAN WATER DISTRICT and SAN DIEGO COUNTY WATER AUTHORITY wherein water usage qualifies for agricultural rebate. A commercial venture that produces a product. A commercial venture which buys or sells items (whole- sale or retail) or provides services for hire. Hotels and motels, with transient customers. A facility owned and operated by City, County, State or Federal government. Retail - Fire Protection Service Any service and meter connec- tion installed specifically for fire protection service. Retail - Construction A temporary service and meter installed for construction purposes only. 3. The rates on a monthly basis charged for all water delivered by the District shall be as follows: Wholesale : $14.00 per acre foot, plus -4- the average cost of the water to the District for the preceding month. The cost of the water to the District shall be the amount charged by San Diego County Water Authority for the water, plus the cost of chlorination used for water purification. There shall be an additional charge of $13.00 per acre foot for water sold for use in Improvement Districts 2 and 3. There shall be an additional charge of $1.00 per acre foot per mile for any water using the pipelines of Improvement Districts 2 and 3, to trans- port water for sale outside of Improvement Districts 2 and 3. Wholesale Water Readings and Billings - Wholesale water meter readings shall be made monthly and billings shall be rendered on a monthly basis. 5. Retail Water Readings and Billings - Retail water readings and billings shall be rendered based upon the type of user -5- as follows: Retail - Retail - Retail - Retail - Retail - Retail - Retail - Retail - Retail - Retail - Residential- Individual Residential- 1 Mu1 t i p 1 e ) Res ident ial- Condominium Mobile Home Parks) Agricultural Business 1 Special (Hotels ) and Motels, with ) transient cus- ) tomers) Government a 1 Agency Facilities) Fire Protection ) Service ) Construction 1 Bi-Monthly Monthly In reference to Retail - Residential - Individual, the General Manager shall have the discretion to cause monthly billing if the General Manager deter- mines it is necessary for the best interests of the District. 6. Deposits on Water Usage - a. The General Manager shall have the discretion to cause a deposit for water usage to be made by any type of water user if the General Manager determines it is necessary for the best interests of the District. b. All Retail - Construction services shall require a $300.00 deposit. 7. Delinquency - a. Any water bill unpaid fifteen (15) days after the date of mailing of said water bill shall be deemed delinquent. b. Any delinquent bill shall be subject to a penalty of ten per cent (10%) of the amount due or the sum of $1.00, whichever is greater. -6- 8. 9. c. Any connection with a delinquent water bill shall be subject to discontinuance and removal until all charges are paid. Reconnection Fee - A reconnection of a meter connection shall be subject to the actual cost of such reconnection or the sum of $10.00, whichever is greater. Control of Service Connections - All service connections to facilities of the District shall be under the exclusive manage- ment and control of the District, or through its designated agent, and no user, wholesale or retail, shall have the right to operate any connections, meter, recording device or valve used in conjunc- tion therewith. Any violation of this section shall entitle the District to discontinue the delivery of water to the party violating this section. - The District shall be responsible for maintenance and repair of service connections and meters connected directly to its lines. At the discretion of the Board, the cost of repair for damaged meters where the damage is caused by other than ordinary use, shall be borne by user. The District shall have the right of access at all reasonable times to user's premises for any pur- pose normally connected with the furnishing of water service. 10. Apportionment During Times of Shortage - During times of shortage, or threatened shortage, of supply, the District will apportion available water among its wholesale and retail users in accordance with the provisions of the Municipal Water District Act of 1911, as amended, assigning priorities to domestic and other uses as may be found necessary by the Board of Directors of the District after due process. 11. Fire Service - Fire service connections may be installed at the expense of the user provided that no water from such connec- -7- tions shall be used for purposes other than to extinguish fires. 12. Effective Date of Rates and Charges - The rates and charges set forth herein shall become effective July 1, 1979, subject to the following exceptions: a. The effective date for all Retail - Individual accounts whose next meter reading closing date is July 15, 1979 shall be July 15, 1979. b. The effective date for all Retail - Individual accounts whose next meter reading closing date is August 15, 1979 shall be August 15, 1979.
