A RESOLUTION OF THE BOARD OF DIRECTORS OF
COSTA REAL MUNICIPAL WATER DISTRICT
ESTABLISHING THE APPROPRIATIONS LIMIT FOR
COSTA REAL MUNICIPAL WATER DISTRICT FOR THE
FISCAL YEAR COMMENCING JULY 1, 1980 AND ENDING
JUNE 30, 1981 IN ACCORDANCE WITH ARTICLE XI11 B
OF THE CONSTITUTION OF THE STATE OF CALIFORNIA AND DIVISION 9 OF THE GOVERNMENT CODE OF THE
STATE OF CALIFORNIA
WHEREAS, Section 1 of Article XI11 B of the Constitution of
the State of California provides that the total annual appropriations
of each local government shall not exceed the appropriations limit
of such entity of government for the prior year, adjusted for changes

in the cost of living and population, subject to certain specified ex-
ceptions in said Article; and
WHEREAS, Section 8 of Article XI11 B of the Constitution of
the State of California defines "Appropriations subject to limitation"
of an entity of local government as "any authorization to expend dur-
ing a fiscal year the proceeds of taxes levied by or for that entity
and the proceeds of state subventions to that entity" (other than sub-
ventions made pursuant to new programs or services mandated by the
State Legislature) "exclusive of refunds of taxes" ; and
WHEREAS, Section 7910 of the Government Code of the State of

California provides that each year the governing body of each local
jurisdiction shall, by resolution, establish its appropriations limit
for the following fiscal year pursuant to Article XI11 B of the Con-

stitution of the State of California at a regularly scheduled meeting
or noticed special meeting; and

WHEREAS, Section 7910 of the Government Code of the State of
California provides that, fifteen (15) days prior to the meeting adopt-
ing the resolution establishing the appropriations limit of the local
jurisdiction for the next fiscal year, the documentation used in the
determination of the appropriations limit shall be available to the
public; and
WHEREAS, the documentation used in determining the appropri-
ations limit adopted in this resolution has been available to the
public for fifteen (15) days prior to the adoption of this resolution.
c NOW, THEREFORE, THE BOARD OF DIRECTORS OF COSTA REAL MUNICIPAL
WATER DISTRICT DOES HEREBY RESOLVE AND ORDER AS FOLLOWS:
1. The appropriations limit for COSTA REAL MUNICIPAL WATER
DISTRICT, pursuant to Article XI11 B of the Constitution of the State
of California for the fiscal year commencing July 1, 1980 and ending
June 30, 1981 is $184,729.18.
2. In accordance with Section 2, Article XI11 B of the Con-
stitution of the State of California, any revenues received by COSTA
REAL MUNICIPAL WATER DISTRICT in excess of that amount, which is ap-
propriated in compliance with Article XI11 B of the Constitution of
__ the State of California, during the fiscal year shall be returned by a
revision of tax rates or fee schedules within the next two subsequent
fiscal years .

of Directors of said District at an adjourned regular meeting of the
Board held on the 26th day of June, 1981, and that it was adopted by
