RESOLUTION OF THE BOARD OF DIRECTORS OF
COSTA REAL MUNICIPAL WATER DISTRICT
ESTABLISHING CONSTRUCTION CHARGES FOR WATER SERVICE LINE CONNECTIONS AND INSTALLATION OF FIRE HYDRANTS
WHEREAS, COSTA REAL MUNICIPAL WATER DISTRICT has been col-
lecting construction charges for water service line connections and
installation of fire hydrants within the prior retail water service
area of COSTA REAL MUNICIPAL WATER DISTRICT: and
WHEREAS, CITY OF CARLSRAD has been collecting construction
charges for water service line connections and installation of fire
hydrants within the prior retail water service area of the CITY OF
CARLSRAD: and
WHEREAS, under the Water Service Agreement, executed May 25,
1983, between CITY OF CARLSRAD and COSTA REAL MUNICIPAL WATER DIS-
TRICT, all construction of water service line connections and instal-
lation of fire hydrants will now be performed by COSTA REAL MUNICIPAL
WATER DISTRICT: and
WHEREAS, it is deemed to be to the best interest of all
parties desiring to secure water service line connections and fire
hydrants within the boundaries of COSTA REAL MUNICIPAL WATER DIS-
TRICT to establish a uniform rate for construction charges for all
water service connections and installation of fire hydrants within
the boundaries of COSTA REAL MUNICIPAL WATER DISTRICT, constructed
and/or installed by COSTA REAL MUNICIPAL WATER DISTRICT: 7

NOW, THEREFORE, THE BOARD OF DIRECTORS OF COSTA REAL MUNICI- -
PAL WATER DISTRICT DOES HEREBY RESOLVE AND ORDER AS FOLLOWS:
1. The construction charges for a water service connection
constructed by COSTA REAL MUNICIPAL WATER DISTRICT shall be as fol-
lows:

7 2. The construction charges for installation of a fire hy-
drant installed by COSTA REAL MUNICIPAL WATER DISTRICT shall be the
actual installation cost, with a deposit of $2,500.00 per fire hy-
drant.
3. In any event where an individual is required to post a
deposit for construction charges of a water service connection or
installation of a fire hydrant, the individual shall be responsible
for paying the actual construction cost or installation cost. In
the event that the actual construction cost or installation cost is
less than the deposit, the individual shall receive a refund of any
excess funds deposited over the actual construction costs or instal-
- lation costs.
4. The CITY OF CARLSRAD Street Department shall be utilized
for all paving and patching of streets where required as a result of

4 the construction of a water service connection or installation of a
fire hydrant. COSTA REAL MUNICIPAL WATER DISTRICT will pay to the
CITY OF CARLSBAD $185.00 for the services rendered by the CITY OF
CARLSBAD Street Department. Such $185.00 shall be a portion of the
construction charges established herein for water service line con-
nections and installation of fire hydrants.

by certify that the foregoing Resolution was duly adopted by the
Board of Directors of said District at a regular meeting of the Board
held on the 15th day of February, 1984, and that it was adopted by the
