HomeMy WebLinkAbout1984-09-19; Municipal Water District; Resolution 457RESOLUTION NO. 457 RESOLUTION OF THE BOARD OF DIRECTORS OF COSTA REAL MUNICIPAL WATER DISTRICT DECLARING THE PUBLIC NECESSITY FOR THE ACQUISITION OF PROPERTY FOR CONSTRUCTION, OPERATION, REPAIR AND MAINTENANCE OF A RESERVOIR AND RELATED EASEMENTS FOR PIPELINES, INGRESS AND EGRESS AND CONSTRUCTION, AND AUTHORIZING PROCEEDINGS IN EMINENT DOMAIN FOR THE PURPOSE OF ACQUIRING REAL PROPERTY AND INTERESTS IN REAL PROPERTY TO BE USED IN CONNECTION THEREWITH WHEREAS, COSTA REAL MUNICIPAL WATER DISTRICT is a municipal water district organized and existing under the provisions of The Municipal Water District Law of 1911, as amended, (Division 20 of the Water Code of the State of California); and WHEREAS, it is necessary for the District to acquire pro- t perty for construction, operation, repair and maintenance of a re- I servoir and related easements for pipelines, ingress and egress and construction; and WHEREAS, public convenience and necessity require the ac- quisition for and in connection with the aforesaid public improve- ment of the real property and interests in real property described in Exhibit "A" attached hereto; and WHEREAS, said public improvement is planned and located in a manner that will be most compatible with the greatest public good and the least private injury; and WHEREAS, said parcels are not located within the boundaries c of the COSTA REAL MUNICIPAL WATER DISTRICT, and Water Code Section 71694 has been complied with pursuant to approval of the San Diego County Board of Supervisors dated August 15, 1984; and -1- WHEREAS, portions of said parcels are presently devoted to a public use, to wit, electric utility lines of San Diego Gas and Electric Company; and P WHEREAS, COSTA REAL MUNICIPAL WATER DISTRICT is authorized to acquire said parcels by eminent domain pursuant to Water Code Sections 71693 and 71694 and Code of Civil Procedure Sections 1240.010, 1240.110, 1240.120 and 1240.610; and WHEREAS, COSTA REAL MUNICIPAL WATER DISTRICT has, pursuant to Government Code Section 7267.2, offered to purchase the property and interests therein described in Exhibit "A" attached hereto at a price not less than the fair market value of said property as deter- mined by an independent appraiser in an appraisal approved by the Board; and WHEREAS, the nature and opportunity to be heard required by Code of Civil Procedure Section 1245.235 has been given to the af- fected property owner; NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of COSTA REAL MUNICIPAL WATER DISTRICT finds and determines and hereby declares as follows: 1. The public interest, convenience and necessity of COSTA REAL MUNICIPAL WATER DISTRICT and the inhabitants thereof re- quire the proposed reservoir project. rc I 2. The public improvements to be constructed upon, over, , under, along and across the property and interests therein described -2- in Exhibit "A" have been planned and located in the manner which will be most compatible with the greatest public good and the least private injury. t 3. The property and interests therein described in Exhibit "A" are necessary for the proposed project. 4. The use to which the property and interests therein is to be made pursuant to Code of Civil Procedure Section 1240.610 is a more necessary public use than the use to which the property is currently appropriated. 5. The offer required by Government Code Section 7267.2 has been made to the owner of record. 6. The COSTA REAL MUNICIPAL WATER DISTRICT and all appro- - priate officers, representatives and attorneys are authorized and I directed to acquire said real property and interests therein de- scribed in Exhibit "A" in the name of and on behalf of COSTA REAL MUNICIPAL WATER DISTRICT, and to that end they are authorized and directed to commence and to prosecute an action or actions in emi- nent domain for the purpose of acquiring said real property and in- terests therein. 7. The COSTA REAL MUNICIPAL WATER DISTRICT has urgent need ' for the immediate possession of such property and interests therein, and the appropriate officers, representatives and attorneys of the District are authorized and directed to secure an order of court authorizing the District to take possession of said property and in- terests therein at the earliest possible date. c -3- ADOPTED, SIGNED AND APPROVED this 19th day of September, 1984. ,, ,’ /‘ 3;- Lhn J / N.
