HomeMy WebLinkAbout1986-04-16; Municipal Water District; Resolution 499RESOLUTION NO. 499 RESOLUTION OF THE BOARD OF DIRECTORS OF COSTA REAL MUNICIPAL WATER DISTRICT RECLASSIFYING AN ENGINEERING TECHNICIAN I1 TO A 111, CLARIFYING PROBATIONARY EMPLOYEE RIGHTS, AND ADDING JOB DESCRIPTIONS FOR SENIOR ENGINEERING TECHNICIAN, ENGINEERING TECHNICIAN 111, AND OFFICE AIDE/INTERN 7 , WHEREAS, the Board of Directors has determined that it is necessary to reclassify the job classification of Engineering Technician I1 to Engineering Technician 111; and WHEREAS, it is also in the best interest of the District to clarify the rights of probationary employees; and WHEREAS, the Board desires to approve job descriptions for Senior Engineering Technician, Engineering Technician 111, and Office Aide/Intern; and WHEREAS, there exists a need for part time assistance 7 which can be accomplished by an Office Aide/Intern; and WHEREAS, it is necessary to amend Article 3 Section 1, Article 4 Section 4, Article 4 Sections 6(g) and (k) according to the Exhibits attached; NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE COSTA REAL MUNICIPAL WATER DISTRICT DOES HEREBY DETERMINE AND RESOLVE that the Administrative Code is hereby amended as described in the attached Exhibits. Salary Schedule and Job Classification. CLASSIFIED POSITIONS (continued) Sec. 4.6. Termination of Employment (continued) (f) Termination Procedure. Except in an emergency the following procedure will be followed: The employee shall be provided with a written notice ofthe fact andeffectivedate oftermi- ation and reminded of his/her right to repre- sentation. If the General Manager, in his discretion, deems it appropriate, the reasons for the termination may be stated in the termination notice; provided, however, that the reason(s1 (cause) must be stated in disciplinary termination. Persons who are terminated may be entitled to unemployment compensation. (9) Employee's Request for Reconsideration. An em- ployee, other than a probationary employee, may request that the General Manager reconsider the decision to terminate the employee. Probation- ary employees may not request reconsideration. The request for re-consideration must be submit- ted in writing within fourteen (14) days after the notice of termination has been mailed or delivered personally to the employee. In the event the request is not received within this period of time, the opportunity to request reconsideration will be waived. A request for reconsideration must be in writing and must contain the following information: (i) The reason reconsideration is requested. CLASSIFIED POSITIONS (continued) Sec. 4.6. Termination of Employment (continued) (9) Employees Request for Reconsideration. (cont.) (iii) If the request for reconsideration is to be supported by statements of other per- sons, the written statements of those persons must be included in the request, together with any documents to be con- sidered. The GeneralManagermay,as amatter of discre- tion, determine that a hearing will facilitate his decision on reconsideration and may require a hearing. In the event the General Manager determines, in his sole discretion, that a hearing is appro- priate, he shall establish the time and place of the hearing and notify the employee con- cerned. (h) Conduct of the Hearinq. Unless the General Manager determines otherwise, the hearing shall be conducted in closed session unless the employee desires an open session. The General Manager shall conduct the hearing. The employee shall be entitled to have repre- sentation to assist the employee in the presen- tation of his case; the General Manager may designate a person to present the District's position with respect to termination. The employee shall have the burden of proving that the initial decision to terminate the em- ployee should be reversed and the employee should be retained by the District. The hearing shall be conducted in an informal manner; the General Manager shall make appropriate rulings with respect to procedure COSTA REAL MUNICIPAL WATER DISTRICT ADMINISTRATIVE CODE 4 TITLE : CLASSIFIED POSITIONS Latest Revision April 16, 1986 ARTICLE 4. CLASSIFIED POSITIONS (continued) Sec. 4.6. Termination of Employment (continued) (h) Conduct of the Hearing. (continued) and the admission of evidence or information for consideration. The District and the employee shall have the right to produce evidence, to produce witnesses, and to cross- examine witnesses who are presented by the op- posing party. The hearing may be recorded and transcribed. The costs incurred for Court Reporter's ser- vices and the preparation of the record initi- ally shall be borne by the District. (i) Waiver of Reconsideration. A failure to request reconsideration in the manner set forth in paragraph (g) above, or failure of the em- ployeetoappearatthetime and place of hear- ing shall be deemed a waiver by the employee of reconsideration by the General Manager and ac- ceptance of the termination. (j) Notice of Decision. The General Manager shall notify the employee of his decision. The notice shall be in writing, dated, and shall inform the employee whether the employee is re- tained or terminated. The time limit for judi- cial review of the final decision of the Gen- eral Manager pursuant to the Code of Civil Pro- cedure S1094.6 runs from the date the notice is deposited in the mail. (k) Petition to the District Board of Directors. An employee, other than a probationary employee,- has thirty (30) days-from the date the General Manager's decision is deposited in the mail to petition the District Board of Di- rectors for review of the General Manager's decision. (continued) examination will be based on the record of the General Manager's action. In the event the Board of Directors either denies the petition or determines to sustain the General Manager's decision, the time limit for judicial review of the Board's decision pursuant to Code of Civil Procedure S1094.6 runs from the date the notice is deposited in the mail. The Board of Directors shall inform the employee in writing of the Board's decision. (1) Benefit Termination Date. An employee shall not be entitled to any benefits effective the day following the day that the status of em- ployment is terminated. Employment is termi- nated as of the last day the employee performs work or a service for the District. The day of termination is not extended through the period of accumulated vacation or sick leave the employee is entitled to as of the date of termination. Sec. 4.7. Part-Time Employees. The General Manager may em- ploy persons on a temporary or regular part-time basis at his discretion as work load demands. Part-time employees shall be defined as those em- ployees who are scheduled to work less than the regularly scheduled work week on a regular and con- sistent basis. Regular part-time employees shall not receive the same accrual rate for vacation or sick leave as the full-time employee.
