HomeMy WebLinkAbout1987-12-02; Municipal Water District; Resolution 561I RESOLUTION NO. 561 RESOLUTION OF THE BOARD OF DIRECTORS OF COSTA REAL MUNICIPAL WATER DISTRICT AMENDING ADMINISTRATIVE CODE SECTION 5.34 REGARDING SPECIAL HOUSING FACILITIES WHEREAS, the Board of Directors of the Costa Real Munil Water District currently has a policy regarding use of caretaker's quarters, and WHEREAS, the current'caretaker using those quarters wi: moving as soon as another caretaker is chosen, and WHEREAS, more detailed conditions are needed before an1 I employee is assigned as caretaker; NOW, THEREFORE, the Board of Directors of the Costa Municipal Water District does hereby amend Section 5.34, Spt Housing Facilities, of the District's Administrative Code attached pages of Article 5). Special Merit for Education. The District has developed a special merit award system to mutually benefit employees and the District by stimulating and rewarding employees for educational accomplishments. This program recognizes accomplishment in terms of operator certification according to the following: Grade Amount "_ One TWO Three Four $ 150 $ 300 $ . 500 $1,000 The above compensations are a one lump sum award, grant- ing of to be determined by the employee's supervisor with approval by the General Manager. The General Manager may recognize other certifications according to their comparability to the above defined certificates. 1 Sec. 5.33. Defense of Public Employees. Pursuant to the Gov- ernment Code, Section 995 - Authority to provide for defense of civil action or proceeding, except as other- wise provided in Section 995.2 and 995.4, upon request of an employee or former employee, the District shall provide for the defense of any civi 1 action or proceeding brought against the employee, in the employee's official or individual capacity or both, on account of a nonmalicious, good-faith act or omission in the scope of employment as an employee of the District. A cross-section, counterclaim or cross-complaint against an employee or former employee shall be deemed to be a civil action or proceeding brought against the employee. Sec. 5.34. Special Housing Facilities. The District main- tains a residence at Squires Dam. The purpose of this residence is to provide security for District facil- ities. The following conditions apply to employee as- signment as caretaker: 1 1. Employee Status. The employee assigned as caretake1 at Squires Dam shall be a full-time permanent employee. 5 27 WORKING HOUR EMPLOYEE BEN I December 2, 1987 ARTICLE 5. WORKING HOURS, EMPLOYEE BENEFITS (continued) Sec. 5.34. Special Housing Facilities. (continued) 2. Priority of Assignment. In the event of a vacancl at the caretaker residence, priority of assignment shall be operations crew members first and construction crew next. Within crew members, longevity with the District shall be the second criterion. 3. Sole Place of Residence. The crew member assignee as caretaker shall maintain the residence as his/heI sole place of residence, II I 4. Others Living at Residence. Only District employees and a reasonable number of persons who constitute E bona fide single housekeeping unit shall be allowec to reside at the house. 5. Responsibilities. The employee and not the Dis- trict, shall be responsible for the general main- tenance of the house and surrounding property. Thc employee shall also be expected to provide securitl during nonworking hours by having themselves, E member of their household or another District employee onsite four weeknights per week and at least three weekends per month. The employee shall be expected to respond to emergency situations tc include the chlorination facility, the hydroelectric facility and the mobile chlorination equipment. Thc employee shall make a visual inspection of thc entire site at least weekly and shall repair an] minor fence breaks. The employee shall drive z District vehicle. No more than three privatc vehicles shall be kept at the residence, Nc overtime or supplemental compensation shall be paic for these duties. 6. Rent. (continued) District shall furnish the water supply ani electricity for the residence and the District employee shall be responsible for the balance of thc utilities. Upon change of resident the District shall have the propane tank filled and bill the outgoing resident. 7. Firearms. The employee shall not carry any firearms in the performance of his/her duties as caretaker nor in District vehicles and shall not discharge an1 firearms on Distri'ct property. 8. Parties. The employee shall notify the Genera3 Manager in advance of any party at the residence involving 15 or more people. I 9. Pets. The employee shall be allowed to have only non-house pets and any pets shall remain within the fenced portion of the property provided for this purpose. Any pets shall not be known to be vicious. 10. Term. The District maintains the right to change the assignment of the caretaker responsibility based solely on determination of the District. It is the intent of this provision to create an at-will tenancy. There shall be an annual review of the caretaker's performance with the Superintendent and General Manager. Sec. 5.35. Deferred Compensation. The District has estab- lished a Deferred Compensation Plan which employees may voluntarily participate in. The District matches employee contributions up to a maximum of 7.5% of an employee's bi-weekly earnings. Sec. 5.36. Use of District Credit Card by Staff. District staff may use District credit cards to pay for items which are proper District expenses.
