A RESOLUTION OF THE BOARD OF DIRECTORS OF
THE CARLSBAD MUNICIPAL WATER DISTRICT, ACCEPTING A BID AND AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR PAINTING
THE EXTERIOR OF TWO WATER STORAGE RESERVOIRS - CMWD PROJECT 90-105

! SECTION 00530 - AGREEMENT
THIS AGREEMENT, made and entered into this day of , 1990, by and between CARLSBAD MUNICIPAL WATER DISTRICTf hereinafter referred to as IgDistrict" and , hereinafter referred to as Contractor."
WITNESSETH:
1. Contractor shall, under the direction and to the
satisfaction of District, furnish all labor, materials,
equipment, transportation and services for:
PAINTING THE EXTERIOR OF (2) WATER STORAGE RESERVOIRS
(ELM AND SKYLINE)
in the principal sum of $ in accordancr
with the plans and contract specifications documents, all oJ
which are incorporated herein by reference and made a part hereof.
2. Contractor shall pay to any laborer, mechanic or apprenticc
employed, the prevailing rate of hourly wages and rates fol legal holidays, overtime work, and standard apprentice wage: as set forth in the Advertisement for Bids and keep adequatt records thereof. Contractor shall, accordingly, pay as z penalty to the District the sum of up to One Hundred Dollar:
($100.00) for each calendar day or portion thereof for eacl workman paid less than the prevailing and standard wagc under this contract, by Contractor and/or any sub- contractor.

3. Contractor shall commence construction within ten (10:
calendar days from receipt of Notice to Proceed and pursuf
said work in a diligent and workmanlike manner withoui
interruption and complete construction thereof within ninet
(90) calendar days as noted in the Notice to Proceed.
4. District agrees to pay and Contractor agrees to accep proportionate payments as Work progresses according t specification, subject to additions and deductions provide therein, all in accordance with the applicable provisions o Standard Specifications for Public Works Construction whic sums shall be computed for the prices set forth in the bi submitted by the Contractor.
5. The Contractor will commence the work required hereunde when required by the Notice to Proceed, and shall complet the work within the following times thereafter: I Ninety (90) Calendar Days

noted in Paragraph SP 6-9 in Section 00800 of thes specifications, after the stipulated completion date(s) tha the work remains uncompleted.
6. This agreement shall be binding upon all Parties hereto an their respective heirs, executors, administrators successors, and assigns, but shall not be assigned by eithe Party without the express written consent of the other.
