RESOLUTION NO. 737
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
CARLSBAD MUNICIPAL WATER DISTRICT FOR
ACCEPTING A BID AND AUTHORIZING THE EXECUTION
OF AN AGREEMENT FOR THE CONSTRUCTION OF THE
JEFFERSON STREET WATER LINE PROJECT IN THE
CITY OF CARLSBAD, CMWD PROJECT NO. 89-101
WHEREAS, the Board of Directors of the Carlsbad Mu
Water District of Carlsbad, California, as follows:
1. That the bid of Sun Valley Construction Co
13675 Highway 8 Business, El Cajon, California 92021, in the
of $254,244.01 is hereby accepted.
2. That the President of the Board of Directors

SECTION 00530 - AGREEMENT

WITNESSETH:
1. Contractor shall, under the direction and to t satisfaction of District, furnish all labor, material
equipment, transportation and services for:

IN THE CITY OF CARLSBAD.

2. Contractor shall pay to any laborer, mechanic or apprenti
employed, the prevailing rate of hourly wages and rates f
legal holidays, overtime work, and standard apprentice waq
as set forth in the Advertisement for Bids and keep adequa
records thereof. Contractor shall, accordingly, pay as
penalty to the District the sum of up to One Hundred Dolla
($100.00) for each calendar day or portion thereof for ea
workman paid less than the prevailing and standard wa
under this contract, by Contractor and/or any su
contractor.
3. Contractor shall commence construction within ten (1
calendar days from receipt of Notice to Proceed and purs
said work in a diligent and workmanlike manner withc
interruption and complete construction thereof within nine
(90) calendar days as noted in the Notice to Proceed.
4. District agrees to pay and Contractor agrees to acce proportionate payments as Work progresses according specification, subject to additions and deductions provic therein, all in accordance with the applicable provisions Standard Specifications for Public Works Construction whj sums shall be computed for the prices set forth in the k submitted by the Contractor.
5. The Contractor will commence the work required hereunc
when required by the Notice to Proceed, and shall complc the work within the following times thereafter:
