RESOLUTION NO. 905
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
CARLSBAD MUNICIPAL WATER DISTRICT, CALIFORNIA
AS REQUIRED BY ARTICLE XlllB OF THE CALIFORNIA
STATE CONSTITUTION AND STATE LAW
ESTABLISHING THE 1995-96 APPROPRIATION LIMIT
WHEREAS, Article XlllB of the California State Constitution requires
that governments annually establish a limit on the appropriation of
proceeds of taxes; and
WHEREAS, State law requires that this limit be presented to the
governing body of each entity each fiscal year; and
WHEREAS, State law also requires that this limit be published in a
newspaper of general circulation to allow public response to the limit as
adopted.
NOW, THEREFORE] BE IT RESOLVED by the Board of Directors of
the Carlsbad Municipal Water District, California, as follows:
1. That the Board of Directors of the Carlsbad Municipal Water
District, California] does hereby establish and adopt the 1995-96
appropriation limit of one million, two hundred seventy-three thousand, one
hundred and ninety dollars ($1,273,190) as computed in Exhibit A attached
hereto.
2. That the Secretary is directed ta publish this Resolution in a
newspaper of general circulation.

GANN APPROPRIATIONS LIMIT
The Appropriations Limitation imposed by Proposition 4 and modified by Proposition 1 '
creates a restriction on the amount of revenue which can be appropriated in any fisc
of taxes." The basis for calculating the Limit began in fiscal year 1978-79 and
increased based on population growth and inflation.
The major change made by Proposition 11 1 allows the Carlsbad Municipal Water Distr.
to annually choose among the following options for calculating its Gann Limit:

The spending limit for the Carlsbad Municipal Water District for 1995-96 is $l,273,1S
with no appropriations of "proceeds of taxes". All revenues subject to the Gan
Appropriations Limit are appropriated within the capital replacement fund and ar
therefore exempt.
