RESOLUTION NO. 930
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A REIMBURSEMENT AGREEMENT FOR THE
CONSTRUCTION OF POINSETTIA PARK OFFSITE SEWER, CMWD
PROJECT NO. 94-403, CITY PROJECT NO. 3348
WHEREAS, a Reimbursement Agreement has been prepared between Carlsbad Mun
District and Greystone Homes, Inc., McReynolds Family Trust, MSP California LLC, and Sar
Heights LLC for the construction of the Poinsettia Park Offsite Sewer, CMWD Project No. 94-
WHEREAS, the purpose of the Reimbursement Agreement is to reimburse the District
of designing and constructing the Poinsettia Park Offsite Sewer up to the amount of $400,(
understanding that any cost in excess of $400,000 shall be paid by the District; and
WHEREAS, District will be funding this project from its Sewer Capital Replacement
amount of $415,000 which includes a contingency of $15,000, therefore, funds are available
WHEREAS, the District will be reimbursed $400,000 in accordance with the tc
Reimbursement Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad Mur
District as follows:
1. That the above recitations are true and correct.
2. That the Reimbursement Agreement between Carlsbad Municipal Water
Greystone Homes, Inc., McReynolds Family Trust, MSP California, and Sambi-Seaside Heil
reimbursement of the construction of Poinsettia Park Offsite Sewer as directed in accords
agreement which is on file with the Secretary, is incorporated hereby reference, and is accc
3. That the President and the Secretary are authorized to execute the Re

4. That the Director of Finance is hereby authorized and directed to appropriate f
fifteen thousand dollars ($41 5,000) from the Sewer Capital Replacement Fund for fiscal year
this project to remain open until such time as all related services and costs are identified and
the cost of construction of the Poinsettia Park Offsite Sewer, CMWD Project No. 94-403, City
3348.
PASSED, APPROVED AND ADOPTED at a special meeting of the Board of
the Carlsbad Municipal Water District held on the 9th day of APRIL , 1996 by 1
vote to wit:
