A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
CARLSBAD MUNICIPAL WATER DISTRICT OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE FIRST
AMENDMENT TO THE JOINT PARTICIPATION AGREEMENT
FOR THE DEVELOPMENT AND UTILIZATION OF RECLAIMED
WATER BETWEEN THE METROPOLITAN WATER DISTRICT
OF SOUTHERN CALIFORNIA, SAN DIEGO COUNTY WATER
AUTHORITY, AND CARLSBAD MUNICIPAL WATER DISTRICT
FOR THE ENCINA BASIN WATER RECLAMATION PROJECT
PHASE I, CMWD PROJECT NO 91-305

9 WHEREAS, there is now in effect a Joint Participation Agreement (Agreemc
lo I/ between MWD, SDCWA, and CMWD dated January 21, 1993 for the development ar
XI I/ of reclaimed water which provided for the Encina Basin Water Reclamation Projc

(Project) to participate in MWD's Local Projects Program (LPP); and
amendment of existing LPP agreements to incorporate draft terms of a new program 15
WHEREAS, MWD's Board of Directors, at its August 22, 1995 meeting, 14
WHEREAS, operation of the Project commenced in January 1993; and
the Local Resources Program (LRP) for the purposes of improving regional w X

reliability and changing the LPP Contribution from a set rate of $154 per acre-foot
scale, from $0 to a maximum of $250 per acre-foot; and
19 I WHEREAS, in consideration of the potential increase in the LPP Contril

21 Parties have agreed to extend the term of the Agreement from 7 years to 25 years.
22 (1 WHEREAS, the Parties mutually acknowledge that this First Amendrr

Agreement shall be an interim agreement. Development of Reclaimed Water bet
