HomeMy WebLinkAbout1998-06-16; Municipal Water District; Resolution 10185 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 EXHIBIT 6 RESOLUTION NO. 1018 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT, CALIFORNIA AS REQUIRED BY ARTICLE XlllB OF THE CALIFORNIA STATE CONSTITUTION AND STATE LAW ESTABLISHING THE 1998-99 APPROPRIATION LIMIT WHEREAS, Article XlllB of the California State Constitution requires that governments annually establish a limit on the appropriation of proceeds of taxes; and WHEREAS, State law requires that this limit be presented to the governing body of each entity each fiscal year; and WHEREAS, State law also requires that this limit be published in a newspaper of general circulation to allow public response to the limit as adopted. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad Municipal Water District, California, as follows: 1. That the Board of Directors of the Carlsbad Municipal Water District, California, does hereby establish and adopt the 1998-99 appropriation limit of one million, nine hundred eight thousand, fifty-eight dollars ($1,908,058) as computed in Exhibit A attached hereto. 111 Ill Ill v ll 0 0 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2. That the Secretary is directed to publish this Resolution in a newspaper of general circulation. PASSED, APPROVED AND ADOPTED at a regular meeting of the Board of Directors on the 16 day of June , 1998, by the following vote, to wit: AYES: Board Members Lewis, Nygaard, Finnila, Hall & Kulchin NOES: None ABSENT: None ATTEST: en (SEAL) t 0 0 Exhibit A GANN APPROPRIATIONS LIMIT The Appropriations Limitation imposed by Proposition 4 and modified by Proposition 11 1 creates a restriction on the amount of revenue which can be appropriated in any fiscal year. The revenues which are subject to the Limitation are those considered "proceeds of taxes." The basis for calculating the Limii began in fiscal year 1978-79 and is increased based on population growth anci inflation. The major change made by Proposition I1 1 allows the Carlsbad Municipal Watel District to annually choose among the following options for calculating its Ganr Limit; 9 Population growth of Carlsbad, OR > Population growth within San Diego County, AND > Growth in California per capita income, OR 9 Growth in non-residential assessed valuation due to nev construction in the City, The factors used to calculate the 1998-99 Limit were: 9 Population growth of Carlsbad, AND 9 Growth in new non-residential construction The formula is outlined below: 1997-98 Expenditure Limit $1,735,80( % Carlsbad Population Growth Growth in new non-residential construction Net Increase Factor I .051 2 X 1.0457 1.099; 1998-99 Limit (1 997-98 Limit X Factor) $1,908,05t Current Appropriation of Proceeds of Taxes $O.O( The spending limit for the Carlsbad Municipal Water District for 1998-99 i! $1,908,058 with no appropriations of "proceeds of taxes". All revenues subject tc the Gann Appropriations Limit are appropriated within the capital replacemen fund and are therefore exempt.
