RESOLUTION NO. 1031
A RESOLUTION OF THE BOARD OF DIRECTORS OF
THE CARLSBAD MUNICIPAL WATER DISTRICT OF
THE CARLSBAD, CALIFORNIA FOR APPROVAL AND
EXECUTION OF A QUITCLAIM DEED OF A
WATERLINE EASEMENT OVER A PORTION OF

KELLY RANCH VILLAGE E, CMWD PROJECT NO. 96-
WHEREAS, Kelly Land Company; Marvin H. Sippel and Lucia C Sipp
Trustees of the Sippel Revocable Family Trust: co-owners of the property
submitted a request for a quitclaim of a waterline easement which was or
dedicated to the Carlsbad Municipal Water District dated March 30, 1964 re
in the Office of the Recorder of San Diego County on May 20, 1964 as filelpz
90323, and this easement is no longer necessary; and the Developer will m
the existing water pipeline as a private system; and
WHEREAS, the Carlsbad Municipal Water District has determined it tc
the public interest to quitclaim said easement.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Directors
Carlsbad Municipal Water District of Carlsbad, California, as follows;
1. That the above recitations are true and correct.
2. That the Quitclaim Deed conveying a waterline easement over a PO
Kelly Ranch Village E, CMWD Project No. 96-521, which will no longer be
for the purpose for which it was granted nor is it contemplated to be needed
purpose of waterline installation, which in on file with the Secretary i
incorporated by this reference; is approved.

3. That the President is authorized to execute the Quitclaim Deed, anc
Secretary is hereby authorized to cause the original deed to be returned tc
original owner, Kelly Land Company; Marvin H. Sippel and Lucia C. Sippel,
Trustees of the Sippel Revocable Family Trust; to be recorded in the Office c
County Recorder of San Diego County, State of California.
PASSED, APPROVED, AND ADOPTED at a special meeting of the Bo;
Directors of the Carlsbad Municipal Water District held on the 1 day of ~ecc
1998, by the following vote, to wit:
AYES: Board Members Lewis, Nygaard, Finnila & Hall
NOES: None
ABSENT: Board Member Kulchin
