A RESOLUTION OF THE CARLSBAD MUNICIPAL WATER
DISTRICT OF CARLSBAD, CALIFORNIA, ACCEPTING THE Dl,
D2, E, AND ELM RESERVOIRS INTERIOR COATING AND E
AND ELM RESERVOIRS EXTERIOR PAINTING, CMWD
PROJECT NO. 97-109, CONTRACT NO.’S 35351 AND 35291.
WHEREAS, the Dl, D2, E, and Elm Reservoirs interior Coating and E and Elm
Reservoirs Exterior Painting, CMWD project No. 97-109, Contract No.’s 35351 and 35291, has
been satisfactorily completed; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District of Carlsbad, California, as follows:
1 .’ That the above recitations are true and correct.
2. That the Dl, D2, E, and Elm Reservoirs Interior Coating and E and Elm Reservoirs
Exterior Painting, CMWD project No. 97-109, Contract No.3 35351 and 35291, is deemed
complete and hereby accepted.
3. The Secretary is hereby authorized and directed to record the Notice of Completion
for said project and release bonds in accordance with State Law and District Codes.
4. That the Carlsbad Municipal Water District of Carlsbad, California, is hereby
directed to commence maintaining the above described public improvements for said project.
PASSED, APPROVED AND ADOPTED at a special meeting of the Board of Directors of
the Carlsbad Municipal Water District held on the 26th day of January, 1999 by the following
vote, to wit:
