HomeMy WebLinkAbout2000-01-04; Municipal Water District; Resolution 10711 2 3 4 5 0 RESOLUTION NO. 1071 A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT (CMWD) APPROVING A QUITCLAIM FOR AN EASEMENT, ORIGINALLY DEDICATED TO THE CARLSBAD MUNICIPAL WATER DISTRICT OVER THE PROPERTY LOCATED AT THE SOUTHWEST CORNER OF POINSETTIA LANE AND BLACK RAIL ROAD. WHEREAS, the Gallagher Family Trust and Laird Cameron and Catherine Ann Cz have requested the quitclaim of a water easement which was originally dedicated to the C: 7 intersection of Poinsettia Lane and Black Rail Road; and 8 Municipal Water District over a portion of their property located at the southwest corner 6 9 WHEREAS, the water line facilities previously constructed within said easemen. been relocated into the new Poinsettia Lane right-of-way; and 10 WHEREAS, said easement is no longer needed for the purpose for which it was g and is not now nor is it contemplated to be needed for the purpose of future waterline insta 11 12 and 13 WHEREAS the Board of Directors of the Carlsbad Municipal Water Distric determined it to be in the public interest to quitclaim said easements; 14 NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Mur 15 Water District (CMWD) of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 16 17 2. That the quitclaim deed conveying water easements over a portic 18 19 APN 215-070-33 to the Norman G. Gallagher and Debra L. Gallagher Family Trust, with the City Clerk and incorporated by this reference, is approved.
