A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
CARLSBAD MUNICIPAL WATER DISTRICT, CARLSBAD,
CALIFORNIA, ADOPTING THE CITY OF CARLSBAD RULES AND
REGULATIONS FOR IMPLEMENTATION OF THE CALIFORNIA
RFI QCATION ASSlSTANCF I AW
WHEREAS, the Water District is required by Government Code section 7267.8 to
adopt rules and regulations to implement State relocation requirements found in 25 California
Code of Regulations, sections 6000 et. seq., which may be triggered by Water District acquisition
activities; and
WHEREAS, it is desirable that the Carlsbad Municipal Water District, as a
subsidiary district of the City of Carlsbad, have the same rules applicable to its acquisition of real
property and displacement activities as the City itself; and
WHEREAS, Health and Safety Code section 33417.5 creates a Redevelopment
Agency Relocation Appeals Board by operation of law; and
WHEREAS, Government Code section 7266 authorizes a City Council by
Ordinance to designate the Redevelopment Agency Relocation Appeals Board as the Relocation
Appeals Board for the City and all public entities within the City other than State agencies; and
WHEREAS, theCity Council by companion ordinance has established the Housing .
Commission as the Relocation Appeals Board for itself and the Carlsbad Municipal Water District;
and
WHEREAS, Government Code section 7267 exempts from the acquisition
regulations the acquisition of any easement, right-of-way, covenant or other non-possessory
interest in real property to be acquired for the construction, reconstruction, alteration,
enlargement, maintenance, renewal, repair, or replacement of subsurface sewers, waterlines or
appurtenances, drains, septic tanks, or stormwater drains.

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District, a subsidiary district of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the City of Carlsbad Rules and Regulations for Implementation of the
California Relocation Assistance Law on file in the Office of the City Clerk and adopted
contemporaneously herewith by the City Council, are hereby adopted as the Rules and
Regulations for Implementation of the California Relocation Assistance Law for the Carlsbad
Municipal Water District. All references therein to the City and its officers and employees shall be
deemed to be to the Carlsbad Municipal Water District and its officers and employees, and said
rules and regulations shall be implemented by the Carlsbad city employees assigned to the work
of the Carlsbad Municipal Water District pursuant to the operating agreement adopted by the City
and the Carlsbad Municipal Water District on June 25, 1991.
3. That the Housing Commission shall be the Relocation Appeals Board.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the Carlsbad
Municipal Water District held on this 13th day Of February , 2001, by the
following vote, to wit:
AYES: Board Members Lewis, Kulchin, Finnila, Nygaard and Hall.
