A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT (CMWD) TO QUITCLAIM AN
WATERLINES BEING CONSTRUCTED AS PART OF POINSETTIA
EXISTING WATERLINE EASEMENT AFTER ACCEPTANCE OF THE
LANE REACH C. PROJECT NO. 3674.
WHEREAS, Poinsettia Lane Reach C and the associated waterline improvements are
located across private property owned by the Daybreak Community Church of Coastal North
County; and
WHEREAS, permanent roadway, drainage and slope easements and a temporaly
construction easement are required to be obtained from Daybreak Community Church of Coastal
North County to construct, operate and maintain Poinsettia Lane Reach C; and
WHEREAS, after construction of the waterlines included in the Poinsettia Lane Reach C
project are accepted, the existing waterline across APN: 215-080-04 will be removed from service
and the waterline easement across APN: 21 5-080-04 will no longer be needed.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Carlsbad Municipal Water District (CMWD) will quitclaim the existing
waterline easement across parcel 215-080-04 after the CMWD accepts the new relocated
waterline being constructed as part of the Poinsettia Lane Reach C project.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
Water District held on the 4th day of JUNE , 2002 by the
following vote, to wit:
