RESOLUTION NO. 1189
A RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT (CMWD) TO
APPROVE AND AUTHORIZE A TRANSFER OF
APPROPRIATION FOR THE EFFLUENT FLOW EQUALIZATION
JOINT USE FACILITIES, PROJECT NO. 38881, AND PHASE II
PIPELINES, PROJECT NO. 38871.
WHEREAS, on March 5, 2002, by Resolution No. 2002-075, the City Council approved an
agreement between the Encina Wastewater Authority and the City of Carlsbad for the design and
:onstruction of the Flow Equalization Joint Use Facilities; and
WHEREAS, the Encina Wastewater Authority has completed the design of the
=low Equalization Joint Use Facilities, and has notified Carlsbad that its share of the project cost
ias increased to $3,936,000 and its percent share of the project cost has increased from
25 percent to 28.36 percent; and
WHEREAS to be in compliance with the terms of the agreement, the appropriation for the
Droject will need to be increased from $2,970,000 to $3,936,000; and
WHEREAS, there are excess funds in the amount of $2,827,500 from the appropriation for
the Carlsbad Water Recycling Facility, Project No. 36753, and $966,000 of that excess is
wailable to increase the appropriation for the Flow Equalization Joint Use Facilities, Project No.
38881 ; and
WHEREAS, it is estimated that the Recycled Pipelines, Project No. 38871, will require
additional appropriations to complete the various pipelines; and
WHEREAS, there are excess funds in the amount of $2,827,500 from the appropriation for
:he Carlsbad Water Recycling Facility, Project No. 36753, and $1,861,500 of that excess is
available to increase the appropriation for the Recycled Pipelines, Project No. 38871.
NOW THEREFORE BE IT RESOLVED by the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.

2. That the appropriation for the Flow Equalization Joint Uses Facilities,
Project No. 38881, shall be increased by $966,000, the appropriation for the Recycled Water
Pipelines, Project No. 38871, shall be increased by $1,861,500, and the appropriation from the
Carlsbad Water Recycling Facility, Project No. 36753, shall be decreased by $2,827,500.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
Water District held on the 12th day of August , 2003 by the following vote, to wit:
