RESOLUTION NO. 1223
A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT (CMWD), ACCEPTING BIDS AND
AWARDING A CONTRACT FOR THE CONSTRUCTION OF THE
ELCAMINO REAL DOMESTIC WATER AND RECYCLED WATER
TRANSMISSION MAINS. PROJECT NOS. 3446 AND 3887-H.
WHEREAS, the Board of Directors of Carlsbad Municipal Water District has determined
t necessary, desirable, and in the public interest to construct the El Camino Real Domestic Water
and Recycled Water Transmission Mains, Project No. 3446 and 3887-H; and
WHEREAS, on June 8, 2004, the Board of Directors approved the plans and
specifications for the construction of the El Camino Real Domestic Water and Recycled Water
Transmission Mains, Project No. 3446 and 3887-H; and
WHEREAS, six (6) sealed bids were received on July 27, 2004 for the project; and
WHEREAS, the lowest responsive, responsible bid for the project was submitted by Cass
Zonstruction, in the amount of $3,392,703; and
WHEREAS, Subsection 3.28.172(c)(l) of the Carlsbad Municipal Code authorizes the
zxecutive Manager to approve change orders in the amount equal to the contingency set at the
.ime of the bid award

WHEREAS, the estimated project cost for the El Camino Real Domestic Water
Transmission Main is $2,351,223 and there are sufficient funds appropriated in the Water
qeplacement Account, to construct the water pipelines of the project; and
WHEREAS, the El Camino Real Domestic Water Transmission Main is categorically
5xempt from the environmental review process under Section 15302 Class 2 (c) of the Public
iesources Code (California Environmental Quality Act).
WHEREAS, the estimated project cost for recycled water pipelines is $1,832,080 and
here are sufficient funds appropriated in the Phase II Pipeline project, Project No. 38871, to
:onstruct the recycled water pipeline of the project; and
WHEREAS, a Mitigated Negative Declaration has been adopted by the City of Carlsbad
3ty Council by Resolution 2000-37, dated January 25, 2000, as required by the California
invironmental Quality Act for the Recycled Water Transmission Main.

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal

2. That the bid submitted by Cass Construction, in the amount of $3,392,703, for the

required contract and submitting the required bonds and insurance policies, as described in the
contract, within twenty (20) days of adoption of this resolution with the understanding that
