HomeMy WebLinkAbout2005-01-18; Municipal Water District; Resolution 12321 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 1232 A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT (CMWD) ACCEPTING BIDS AND AWARDING THE CONSTRUCTION OF THE INDUSTRIAL PARK PIPELINES, FOR THE ENCINA BASIN WATER RECLAMATION AND 3930 AND APPROPRIATION OF FUNDS. PROGRAM, PHASE II PROJECT, PROJECT NOS. 3887-C, 3667, WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has determined it necessary, desirable, and in the public interest to construct the Industrial Park Pipelines for the Encina Basin Water Reclamation Program, Phase II Project, Project No. 3887-C; and WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has determined it necessary, desirable, and in the public interest to incorporate a pavement overlay project, Project No. 3667, and a fiber optic cable conduit installation, Project No. 3930, into the Industrial Park Pipeline project, Project No. 3887-C; and WHEREAS, the estimated project cost for the Industrial Park recycled water pipelines is $7,803,351 and the Industrial Park recycled water pipelines are part of the Encina Basin Water Reclamation Program, Phase II Project with a total cost of $49.7 million; and WHEREAS, the appropriations totaling $4631 2,424 for the Encina Basin Water Reclamation Program, Phase II Project are insufficient to complete the entire project; and WHEREAS, an additional appropriation of $3,163,844 from the Recycled Water Fund is required to complete all of the Encina Basin Water Reclamation Program, Phase II Project. WHEREAS, the City Council of the City of Carlsbad, California, has agreed to reimburse the Carlsbad Municipal Water District the actual cost for pavement overlay, Project No. 3667, and the placement of fiber optic cable conduit, Project No. 3930, as part of the construction of the Industrial Park Pipeline Project, Project No. 3887-C; and WHEREAS, the low bidder made a mathematical error in preparing his bid, and has requested to be relieved of their bid. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal Water District (CMWD) of the City of Carlsbad, California, as follows: 1. That the bid submitted by Orion Construction is relieved from further consideration. 3. That the bid submitted by J. Fletcher Creamer, in the amount of $8,775,466, for the nstruction of the Industrial Park Pipelines, Project Nos. 38874, 3667, and 3930 is hereby cepted and the Executive Manager is authorized and directed to execute a contract therefore. 4. That the Executive Manager is authorized to approve construction change orders I Project No. 3887-C up to $200,000; for Project No. 3667 up to $176,000; and Project No. 3930 to $20,000. 5. That the award of this contract is contingent upon J. Fletcher Creamer executing ? required contract and submitting the required bonds and insurance policies, as described in 3 contract, within twenty (20) days of adoption of this resolution with the understanding that the :ecutive Manager may grant reasonable extensions of time. 6. That the Finance Director is authorized to appropriate $3,163,844 from the ?cycled Water fund to the Phase I1 project and to allocate this appropriation to the following oject Nos: 36753 CWRF $ 540,000 38881 Flow Equalization $ 557,279 38871 Pipelines $1,202,321 38891 Pump Station $ 158,244 38901 Mah r Reservoir $ 706,000 PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Jnicipal Water District held on the 18th day of JANUARY , 2005 by the lowing vote, to wit: AYES: Board Members Hall, Kulchin, Packard, Sigafoose NOES: None ABSENT: Board Member Lewis iTT HALL, President Pro Tem -TEST: (SEAL)
