RESOLUTION NO. 1248
A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT (CMWD) TO APPROVE AND
AUTHORIZE A LOAN AGREEMENT WITH THE STATE WATER
RESOURCES CONTROL BOARD FOR THE ENCINA BASIN WATER
RECLAMATION PROGRAM, PHASE II, PROJECT NO. 3675.
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District (CMWD) by
Resolution No. 1098 on October 3, 2000, approved and authorized the Executive Manager to
submit an application for a project loan to the State Water Resources Control Board (SW RCB) for
the Encina Basin Water Reclamation Program, Phase II, project; and
WHEREAS, SWRCB, Loan Agreement No. 04-812-550-0 was submitted to CMWD in a'
letter dated June 9, 2005, requesting that CMWD execute the agreement; and
WHEREAS, the agreement awards a maximum loan of $9,817,305 with an interest rate of
2.5% over 20 years.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District of the City of Carlsbad, California as follows:
1. That the above recitations are true and correct.
2. That CMWD's Executive Manager, or his designee, is authorized to execute loan
sgreement No. 04-81 2-550-0 with the State Water Resources Control Board.
PASSED, APPROVED AND ADOPTED at a special meeting of the Carlsbad Municipal
Water District held on the 28th day of JUNE , 2005 by the following vote, to wit:
