2 A RESOLUTION OF THE BOARD OF DIRECTORS OF
CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
3 ACCEPTING THE CONSTRUCTION CONTRACT ON BLACK
RAIL ROAD IMPROVEMENTS, PROJECT NO. 3954 AS
4 COMPLETE
5 WHEREAS, the construction of the Black Rail Road Improvement project has been
6 completed to the Carlsbad Municipal Water District's satisfaction by Portillo Concrete, Inc. on
7 November 14, 2006; and
8 WHEREAS, the formal project Notice of Completion has been prepared; and
9 WHEREAS, all project costs have been established to date.
I ° NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
I1 Water District (CMWD) of the City of Carlsbad, California, as follows:
12 1. That the above recitations are true and correct.

2. That the Black Rail Road Improvements project, specifically identified as Project
14
No. 3954, is deemed complete and is hereby accepted by the Board of Directors of Carlsbad
15
Municipal Water District of the City of Carlsbad, California.
16
3. The Secretary of the Carlsbad Municipal Water District is hereby authorized and
17
directed to execute and record the Notice of Completion for the Black Rail Road Improvements,
18
Project No. 3954.

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of
Directors of the Carlsbad Municipal Water District of the City of Carlsbad on the 23rd
day of January, 2007, by the following vote:
AYES: Board Members Lewis, Hall, Packard, Sigafoose.
NOES: None.
ABSENT: Board Member Kulchin.
