A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
3 MUNICIPAL WATER DISTRICT (CMWD) ACCEPTING THE
CONSTRUCTION CONTRACT ON THE RANCHO SANTA FE ROAD
4 NORTH. PHASE 2 PROJECT. PROJECT NOS. 3907. 3887 & 3923
5 WHEREAS, the construction of the Rancho Santa Fe Road North, Phase 2 project has
6 been completed to the Carlsbad Municipal Water District's satisfaction by FCI Constructors, Inc.
on March 20, 2007; and
WHEREAS, the formal project Notice of Completion has been prepared; and

WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
10 Water District (CMWD) of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
12 2. That the Rancho Santa Fe Road North, Phase 2 project, specifically identified as
Project Nos. 3907, 3887 and 3923, is deemed complete and is hereby accepted by the Board of
Directors of Carlsbad Municipal Water District of the City of Carlsbad, California.
15 3. The Secretary of the Carlsbad Municipal Water District is hereby authorized and
16 directed to execute and record the Notice of Completion for the Rancho Santa Fe Road North,
17 Phase 2 project, Project Nos. 3907, 3887 and 3923.

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of
Directors of the Carlsbad Municipal Water District of the City of Carlsbad on the 17th
day of April, 2007, by the following vote:
AYES: Board Members Lewis, Kulchin, Hall, Packard
NOES: None
ABSENT: Board Member Nygaard
