A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
3 MUNICIPAL WATER DISTRICT (CMWD) ACCEPTING THE
CONTRACT FOR THE DEMOLITION OF PAJAMA DRIVE WATER
4 FACILITY. PROJECT NO. 3955.
5 WHEREAS, the Demolition of Pajama Drive Water Facility, Project No. 3955 was
6 completed on March 4, 2008; and
WHEREAS, all work has been completed to the Carlsbad Municipal Water District's
satisfaction by TC Construction Company, Inc.; and

WHEREAS, the formal project Notice of Completion has been prepared; and
9
WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
11 Water District (CMWD) of the City of Carlsbad, California, as follows:
1")1. That the above recitations are true and correct.
13 2. That the contract for the Demolition of Pajama Drive Water Facility, specifically
14 identified as Project No. 3955, is deemed complete and is hereby accepted by the Board of
15 Directors of Carlsbad Municipal Water District.
1^ 3. The Secretary of the Board is hereby authorized and directed to execute and
17 record the Notice of Completion for the Demolition of Pajama Drive Water Facility, Project No.
18 3955.

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of
Directors of the Carlsbad Municipal Water District of the City of Carlsbad on the 15th
day of April, 2008, by the following vote to wit:
AYES: Board Members Lewis, Kulchin, Hall, Packard and Nygaard.
NOES: None.
ABSENT: None.
