A RESOLUTION OF THE BOARD OF DIRECTORS OF
3 CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
APPROVING PLANS AND SPECIFICATIONS AND
4 AUTHORIZING TO ADVERTISE FOR BIDS FOR THE
CONSTRUCTION OF MAERKLE DISINFECTION FACILITIES
5 CHLORINE GAS SCRUBBERS REPLACEMENT PROJECT NO.
5009-A.

WHEREAS, the Board has determined it necessary and in the public interest to construct
7
the chlorine gas scrubbers at Maerkle disinfection facilities; and
8
WHEREAS, the plans and specifications for furnishing of all labor, materials, tools,
9
equipment, transportation, and other expenses necessary and incidental to the construction of the
10
Maerkle Disinfection Facilities Chlorine Gas Scrubbers Replacement Project NO. 5009-A have
been prepared and are on file in the Engineering Department of the City of Carlsbad and are
incorporated by reference herein; and

WHEREAS, the project is a Class 2 categorical exemption (replacement or reconstruction
of existing structures or facilities) and is, therefore, exempt from environmental review pursuant to15
Section 15302 of the California Environmental Quality Act (CEQA); and16
WHEREAS, there are sufficient funds in the Water Replacement Fund to complete the
18 project.
1g NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board
of Directors of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.

2. That the plans, specifications, and contract documents for the construction of the
22 Maerkle Disinfection Facilities Chlorine Gas Scrubbers Replacement Project NO. 5009-A, on file
23 in the Public Works-Engineering Department of the City of Carlsbad are hereby approved.
O/l 3. The Secretary of the Carlsbad Municipal Water District is hereby authorized and
25 directed to publish, in accordance with State law, a Notice to Contractors Inviting Bids for the
26 construction of the Maerkle Disinfection Facilities Chlorine Gas Scrubbers Replacement Project
27 NO. 5009-A, in accordance with the plans, specifications, and contract documents referred to
28 herein.

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of
Directors of the Carlsbad Municipal Water District of the City of Carlsbad on the 24th
day of June, 2008, by the following vote to wit:
AYES: Board Members Lewis, Kulchin, Hall, Packard and Nygaard.
NOES: None.
ABSENT: None.
