A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
3 MUNICIPAL WATER DISTRICT (CMWD), APPROVING PLANS AND
SPECIFICATIONS AND AUTHORIZING TO ADVERTISE FOR BIDS FOR
4 THE CONSTRUCTION OF MITIGATION LANDSCAPE IMPROVEMENTS
FOR HABITAT REVEGETATION AND MONITORING PROGRAM,
LAKE CALAVERA IMPROVEMENTS. PROJECT NO. 3821.

WHEREAS, the Board has determined it necessary and in the public interest to advertize
7
for bids for construction of the Mitigation Landscape Improvements for Habitat Revegetation and
8
Monitoring Program, Lake Calavera Improvements, Project No. 3821; and
9
WHEREAS, the plans and specifications for furnishing of all labor, materials, tools,
10
equipment, transportation, and other expenses necessary and incidental to the construction of the
11
Mitigation Landscape Improvements for Habitat Revegetation and Monitoring Program,
12
Lake Calavera Improvements, Project No. 3821, have been prepared and are on file in the
13
Engineering Department of the City of Carlsbad and are incorporated by reference herein; and
14
WHEREAS, the conditions of the California Department of Fish and Game Streambed
15
Alteration Agreement No. 1600-2004-0101-R5 require the creation, restoration, maintenance and
16
monitoring for a minimum of 2.2 acres of wetland and non-wetland habitat on the Lake Calavera
17
Improvements, Project No. 3821; and
18
WHEREAS, the project has received the necessary environmental permits from the
19
California Regional Water Quality Control Board and the Department of the Army and an
20
agreement from the California Department of Fish and Game to construct the improvements.
21
WHEREAS, there are sufficient funds currently available to complete Project No. 3821;
22
and
23
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board,
24
as follows:

1. That the above recitations are true and correct.

1 2. That the plans, specifications, and contract documents for the construction of the
2 Mitigation Landscape Improvements for Habitat Revegetation and Monitoring Program,
3 Lake Calavera Improvements, Project No. 3821, are hereby adopted.
4 3. The Secretary of the Carlsbad Municipal Water District is hereby authorized and
5 directed to publish, in accordance with State law, a Notice to Contractors Inviting Bids for the
construction of the Mitigation Landscape Improvements for Habitat Revegetation and Monitoring
Program, Lake Calavera Improvements, Project No. 3821, in accordance with the plans,
specifications, and contract documents referred to herein.8

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of
Directors of the Carlsbad Municipal Water District of the City of Carlsbad on the 22-
day of July. 2008, by the following vote to wit:
AYES: Board Members Lewis, Kulchin, Hall, Packard and Nygaard.
NOES: None.
ABSENT: None.
