A RESOLUTION OF THE BOARD OF DIRECTORS OF
3 CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
ACCEPTING THE CONTRACT FOR CONSTRUCTION OF THE
4 MAERKLE DISINFECTION FACILITIES CHLORINE GAS
SCRUBBERS REPLACEMENT, PROJECT NO. 5009-A, AS
5 COMPLETE.
6 WHEREAS, the construction of the Maerkle Disinfection Facilities Chlorine Gas Scrubbers
7 Replacement, Project No. 5009-A, has been completed to Carlsbad Municipal Water District's
8 satisfaction by Socal Pacific Construction Corp. on June 8, 2010; and
9 WHEREAS, the formal project Notice of Completion has been prepared; and
10 WHEREAS, all project costs have been established to date.
11 NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board
12 of the City of Carlsbad, California, as follows:
13 1. That the above recitations are true and correct.
14 2. That the Maerkle Disinfection Facilities Chlorine Gas Scrubbers Replacement,
15 specifically identified as Project No. 5009-A is deemed complete and is hereby accepted by the
Board of the Carlsbad Municipal Water District.
3. That the Secretary of the Board is hereby authorized and directed to execute and

record the Notice of Completion for the Maerkle Disinfection Facilities Chlorine Gas Scrubbers

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Carlsbad
Municipal Water District of the City of Carlsbad on the 13th day of July, 2010, by the
following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
ABSENT: None.
