RESOLUTION NO. 1401

A RESOLUTION OF THE BOARD OF DIRECTORS OF
3 CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
ACCEPTING THE CONTRACT FOR CONSTRUCTION OF THE
4 MAERKLE RESERVOIR COVER INSPECTION, CLEANING,
REPAIR AND RAINWATER SYSTEM
5 UPGRADE. PROJECT NO. 5005. AS COMPLETE.
6 WHEREAS, the construction of the Maerkle Reservoir Cover Inspection, Cleaning, Repair
7 and Rainwater System Upgrade, Project No. 5005, has been completed to Carlsbad Municipal
8 Water District's satisfaction by Layfield Environmental Systems Corporation on May 16, 2008;
and
10 WHEREAS, the final change order was executed on June 7, 2010; and
WHEREAS, the formal project Notice of Completion has been prepared; and
12 WHEREAS, all project costs have been established to date.
13 NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board
14 of the City of Carlsbad, California, as follows:
15 1. That the above recitations are true and correct.
16 2. That the Maerkle Reservoir Cover Inspection, Cleaning, Repair and Rainwater
17 System Upgrade, specifically identified as Project No. 5005 is deemed complete and is hereby
accepted by the Board of the Carlsbad Municipal Water District.10
3. That the Secretary of the Board is hereby authorized and directed to execute and19
record the Notice of Completion for the Maerkle Reservoir Cover Inspection, Cleaning, Repair

and Rainwater System Upgrade, Project No. 5005.

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of
Directors of the Carlsbad Municipal Water District of the City of Carlsbad on the 27th day
of July, 2010, by the following vote to wit:
AYES: Board Members Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
ABSENT: None.
