2 A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT (CMWD), ACCEPTING THE
CONTRACT FOR CONSTRUCTION OF THE ELLERY, ELM, & SKYLINE
4 STEEL WATER TANKS INTERIOR AND EXTERIOR COATINGS &
STRUCTURAL REPAIRS, PROJECT NO. 50241, AS COMPLETE AND
5 DIRECTING THE SECRETARY TO RECORD A NOTICE OF
COMPLETION AND RELEASE BONDS IN ACCORDANCE WITH STATE
6 LAW AND CITY ORDINANCE.

8 WHEREAS, the construction of the Ellery, Elm, & Skyline Steel Water Tanks Interior and
9 Exterior Coatings & Structural Repairs has been completed to the Carlsbad Municipal Water
District's satisfaction by Simpson Sandblasting and Special Coatings, Inc. on May 30, 2014; and

WHEREAS, the formal project Notice of Completion has been prepared; and
12
WHEREAS, all project costs have been established to date.

14 NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of
15 the City of Carlsbad, California, as follows that:
16 1. The above recitations are true and correct.
2. That the Ellery, Elm, & Skyline Steel Water Tanks Interior and Exterior Coatings &
Structural Repairs, specifically identified as Project No. 50241 is deemed complete and is
hereby accepted by the Board of Directors ofthe Carlsbad Municipal Water District ofthe City

22 3. That the Secretary ofthe Board is hereby authorized and directed to execute and
record the Notice of Completion for the Ellery, Elm, & Skyline Steel Water Tanks Interior and
Exterior Coatings & Structural Repairs, Project No. 50241.

PASSED, APPROVED AND ADOPTED at a Special Meeting ofthe Board of Directors ofthe
Carlsbad Municipal Water District of the City of Carlsbad on the 26*'' day of August, 2014, by
the following vote to wit:
