HomeMy WebLinkAbout2015-06-23; Municipal Water District; Resolution 1527Exhibit 1 1 RESOLUTION NO. 1527 3 2 A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT (CMWD), ACCEPTING BIDS AND AWARDING A CONTRACT TO DICK MILLER INC. IN THE AMOUNT 4 OF $1,097,197 FOR THE CONSTRUCTION OF THE TRI-AGENCIES WATER TRANSMISSION PIPELINE, REACH 2, PHASE 1, LOCATED 5 ON PIRGOS WAY, PROJECT NO. 5008 6 7 WHEREAS, the Board of Directors of the Carlsbad Municipal Water District, California 8 has determined it necessary, desirable, and in the public interest to replace the existing 21 inch 9 Tri-Agencies Water Transmission Pipeline with a new 18 inch steel water pipeline and; WHEREAS, an environmental impact assessment was conducted for the Tri-Agencies Pipeline Project and a Program EIR was approved on Nov. 13, 2012, by the Board of Directors of the Carlsbad Municipal Water District, California by adopted Resolution No. 2012-245; and WHEREAS, on Aug. 26, 2014, the Board of Directors of the Carlsbad Municipal Water District, California adopted Resolution No. 1498, which approved the plans for the construction 10 11 12 13 14 15 of the Tri-Agencies Water Transmission Pipeline, Project No. 5008; and 17 WHEREAS, on Oct. 15, 2014, four sealed bids were received by the Carlsbad Municipal ^ ^ Water District for the construction of the Tri-Agencies Water Transmission Pipeline, Project No. 19 20 21 22 23 to the Board to re-advertise for bids for the construction of the Tri-Agencies Water 24 Tra nsm ssion Pipeline, Project No. 5008; and WHEREAS, seven sealed bids were received on April 21, 2015, by the Carlsbad Municipal 26 Water District for the construction ofthe Tri-Agencies Water Transmission Pipeline, Project No. 27 5008; and 28 5008 and WHEREAS, on Nov. 18, 2014, the Board of Directors of the Carlsbad Municipal Water District, California adopted Resolution No. 1506, rejecting all bids and authorizing the Secretary 1 WHEREAS, the lowest responsive and responsible bid to construct said project was 2 submitted by Dick Miller Inc. in the amount of $1,097,197; and ^ WHEREAS, the Engineer's estimate for the project cost is $1,200,000; and 4 WHEREAS, there are sufficient funds available in the Water Replacement Fund to 5 complete the project; and 6 y WHEREAS, under the operating agreement with the City of Carlsbad, Carlsbad Municipal 8 Water District adopted the city's purchasing rules. 9 NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of 1^ the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 12 2. That the low bid of $1,097,197 submitted by Dick Miller Inc. for the construction of 13 the Tri-Agencies Water Transmission Pipeline, Reach 2, Phase 1, Project No. 5008 is accepted 14 and the President is hereby authorized to execute a contract for this project. 15 Jg 3. That the Executive Manager is hereby authorized to approve construction change 17 orders up to $165,000. 18 4. That the award of this contract is contingent upon the bidder submitting the lowest responsible bid executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within 20 days of adoption of this resolution.
