RESOLUTION NO. 1535
A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT {CMWD) QUITCLAIMING A PORTION
OF A WATER LINE EASEMENT LOCATED WITHIN LOT 5 OF MAP
3179 AND ALL OF A WATER LINE EASEMENT LOCATED WITHIN
LOT 5 OF MAP 3179· PR 15-84
WHEREAS, Douglas Robert Boyd and Carol Jean Boyd, Trustees of the Brandel!
Living Trust, UTD October 14, 2003 and Lauren D. Gleason, Trustee of the Lauren D. Gleason Living
8 Trust, UTD June 11, 2009, have requested to quitclaim a portion of the water facility easement
9 granted to Oceanside Mutual Water Company {OMWD) per document recorded April 15, 1913 in
10 Book 672 Page 362 of Deeds at the Office of the San Diego County Recorder and the water facility
11 easement granted to Carlsbad Mutual Water Company acquired per document recorded
12 November 13, 1953 in Book 5046 Page 409 of Official Records at the Office of the San Diego
13 County; and
14 WHEREAS, the property owner has paid the standard fee for processing this
15 quitclaim; and

WHEREAS, said waterline easements are not required for the purpose for which
17

they were granted and are not now, nor are contemplated to be, needed for future waterline
19 purposes and appurtenant facilities.
20 NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad
21 Municipal Water District {CMWD) of the City of Carlsbad, California, as follows:
22 1. That the above recitations are true and correct.

2. That the CMWD approves the quitclaim of a portion of the water
24
easement, recorded in Book 672 Page 362 of Deeds, as described in Exhibit A of the quitclaim
25
deed. 26

1 3. That the CMWD approves the quitclaim of the water easement, recorded
2 in Book 5046 Page 409, as described in Exhibit A of the quitclaim deed.
3 4. That the quitclaim deed (PR 15-84), which is on file with the Secretary
4
and is incorporated herein by this reference, is approved.

5. That the President is authorized to execute the quitclaim deed and the

adequacy of which are hereby acknowledged, does hereby remise, release, and quitclaim to Douglas
Robert Boyd and Carol Jean Boyd, Trustees of the Brandel! Living Trust, UTD October 14, 2003 and
Lauren D. Gleason, Trustee of the Lauren D. Gleason Living Trust, UTD June 11, 2009 ("Grantee") all
right, title, and interest in the property described in Exhibit A attached hereto and made a part of hereof.

A portion of a 20 foot wide easement for water pipe line purposes recorded in Book
672-362 of Deeds, filed in the office of the Recorder of San Diego County April 30,
1915, lying within Lot 5 in Block "B" of Shangrila Tract, in the City of Carlsbad,
County of San Diego, State of California, according to Map thereof No. 3179, filed
in the office of the Recorder of San Diego County, January 17, 1955.
Parcel B:
All of that certain 10 foot wide easement for water line construction, maintenance
and access purposes recorded in Book 5046 Page 409 of Official Records, filed in
the office of the Recorder of San Diego County November 13, 1953, lying within Lot
5 in Block "B" of Shangrila Tract, in the City of Carlsbad, County of San Diego, State
of California, according to Map thereof No. 3179, filed in the office of the Recorder
of San Diego County, January 17, 1955
