A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT BOARD (CMWD), ACCEPTING THE CONTRACT
FOR CONSTRUCTION OF THE EL CAMINO REAL ROAD WIDENING,
TAMARACK AVENUE TO CHESTNUT AVENUE, PROJECT NOS. 3957, 3643,
6302 & 6303 AS COMPLETE, DIRECTING THE SECRETARY TO RECORD A
NOTICE OF COMPLETION AND RELEASE BONDS IN ACCORDANCE WITH
STATE LAWS AND CITY ORDINANCES, AND AUTHORIZING A REDUCTION OF
RETENTION HELD.

WHEREAS, the construction of the El Camino Real Road Widening, Tamarack Avenue to
Chestnut Avenue, Project Nos. 3957, 3643, 6302 & 6303 was completed to the Carlsbad Municipal
Water District's (CMWD) satisfaction by Los Angeles Engineering, Inc. on Dec. 31, 2016; and
WHEREAS, the formal Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date; and
WHEREAS, Public Contract Code §9203(a) allows the legislative body to make remaining
progress payments after 50 percent of the work has been completed if it finds that satisfactory progress
has been made.
NOW, THEREFORE, BE IT RESOLVED by the CMWD Board of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the El Camino Real Road Widening, Tamarack Avenue to Chestnut Avenue, Project
Nos. 3957, 3643, 6302 & 6303, is deemed complete and is hereby accepted by the Board of Directors
of the CMWD of the City of Carlsbad.
3. That the secretary of the Board is hereby authorized and directed to execute and record
the Notice of Completion, attached hereto as Attachment A, for the El Camino Real Road Widening,
Tamarack Avenue to Chestnut Avenue, Project Nos. 3957, 3643, 6302 & 6303.
4. That staff is authorized to reduce Los Angeles Engineering's retention down to 2.5
percent.
PASSED, APPROVED AND ADOPTED at a Joint Special Meeting of the Carlsbad Municipal Water
District and the City Council of the City of Carlsbad on the 23rd day of May, 2017, by the following vote,
to wit:
AVES: M. Hall, K. Blackburn, M. Schumacher, C. Schumacher, M. Packard.
NOES: None.
ABSENT: None.
