A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL
WATER DISTRICT (CMWD BOARD) OF THE CITY OF CARLSBAD, CALIFORNIA,
TERMINATING THE DECLARATION FOR LOCAL EMERGENCY THAT WAS ISSUED ON
DEC. 11, 2019, CONFIRMED ON DEC. 17, 2019, AND CONTINUED ON JAN. 14 AND
JAN. 21, 2020
WHEREAS, on Dec. 11, 2019, the executive manager declared a local emergency under Public Contract
Code Section 22035 and 22050 and Carlsbad Municipal Code Sections 3.28.llO(A) and 3.28.120 to facilitate the
immediate repair of a potable water main located in the North County Transit District (NCTD) railroad right of
way; and
WHEREAS, on Dec. 17, 2019, the CMWD Board confirmed the Declaration of Local Emergency with a
unanimous vote of 4-0; and
WHEREAS, on Jan. 14, 2020, the CMWD Board continued the Declaration of Local Emergency with a
unanimous vote of 4-0; and
WHEREAS, on Jan. 21, 2020, the CMWD Board again continued the Declaration of Local Emergency with
a unanimous vote of 4-0; and
WHEREAS, the pipeline repair is substantially complete, and staff recommends termination of the
Declaration for Local Emergency, as it is no longer needed.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal Water District of the
City of Carlsbad, California, as follows:
l. That the above recitations are true and correct.
2. That the CMWD Board adopt this Resolution declaring an end to the Local Emergency, issued on
Dec. 11, 2019, confirmed on Dec. 17, 2019, and continued on Jan. 14 and Jan. 21, 2020.
PASSED, APPROVED AND ADOPTED at a Special Meeting of the Carlsbad Municipal Water District of the
City of Carlsbad on the 28th day of January 2020, by the following vote, to wit:
AYES: Hall, Blackburn, Bhat-Patel, Schumacher.
NAYS: None.
ABSENT: None.
