HomeMy WebLinkAbout2007-07-10; Public Financing Authority; Resolution 39Exhibit B 1 2 RESOLUTION NO. 39 3 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD PUBLIC FINANCING AUTHORITY, CALIFORNIA, 4 AUTHORIZING A CHANGE ORDER TO ITS CONTRACT WITH WADSWORTH GOLF COURSE CONSTRUCTION COMPANY 5 NOT TO EXCEED $250,000 TO REPAIR DAMAGE TO THE CROSSINGS AT CARLSBAD GOLF COURSE 6 WHEREAS, on July 3, 2007, an airplane crashed onto The Crossings at Carlsbad Golf Course and causing significant damage; and 8 WHEREAS, current estimates are that the cost of the repair will be approximately 9 $250,000; and 10 WHEREAS, the Carlsbad Public Financing Authority has an existing contract with Wadsworth Golf Course Construction Company for construction of the golf course.12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of I O Carlsbad, California, as follows:14 „ c 1. That the above recitations are true and correct,lo 16 2. That the foregoing accident and resultant damage require immediate repair and 17 restoration of the golf course which is imminently scheduled to open. ^n 3. That the Executive Director or his designee is hereby authorized to execute a 19 change order in an amount not to exceed $250,000 for the repair and restoration. 20 4. ABSENT: None. , Chairman of the Board ATTEST: /CORRAglE M. /(SEAL) Exhibit C DECLARATION OF LOCAL EMERGENCY IN ORDER TO IMMEDIATELY PROCURE EQUIPMENT, SERVICES AND SUPPLIES WHEREAS, the City Council of the City of Carlsbad empowers the City Manager to proclaim the existence of a local emergency when said City is affected by a public calamity and the City Council is not in session; and WHEREAS, the City Manager of the City of Carlsbad, California does hereby find: That conditions of extreme peril to the safety of persons and property have arisen within the City of Carlsbad caused by a plane crash that occurred on the Crossings at Carlsbad Municipal Golf Course on July 3,2007; and That these conditions created unexpected occurrences that posed a clear and imminent danger and required immediate action to prevent or mitigate the loss or impairment of life, health, property, or essential public services, and are or are likely to be beyond the control of the services, personnel, equipment and facilities of the City of Carlsbad; and That these conditions did not permit a delay resulting from a competitive solicitation for bids, and that the action is necessary to respond to the emergency; and That the City Council of the City of Carlsbad was not in session and could not immediately be called into session. NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency now exists throughout the City of Carlsbad, California; and IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency, the powers, functions and duties of the emergency organization of the City of Carlsbad are those prescribed by state law, by ordinances and resolutions of the City of Carlsbad Emergency Plan.
