SEC.TZON 17 (B) (1) Qf ORDANANCE NO. 10 ADDED TO AI 10 AMENDED. 11 follows : 12 Section 17 (€3) (1) of Ordinance No. 10 is hereby amended and. added to rl 13 14 15 16 1, De.sign and Construction Procedure: a. Upon receipt of the application the applicant shall deposit with the district sufficient funds for a preliminary design study of the extended facilities by the district% engineer; the amount of the deposit to be aet-ermiried by the District Engineer. 17 I 18 19 20 21 ! - b. The District Engineer shall then prepare a preliminary design study giving due consideration to the size and hcation of said extended facilities, the type of construction, the area to be served by said extended facilities, an estimate of the reasonable cost of constructing said facilities and a recommendation 'as to whether the facilities to be constructed constitute a portion of the primary distributidn syst-em of the district ~r any Improvement District thereof. 7 23 24 25 26 I c. Upon receipt of the preliminary design study the Board of Directors of the district will determine if the facilities to be constructed, constitute a portion of the primary distrib.ution system of the district or .any Improvement District and determine if the coristruction of said facilities in accordance with. the preliminary design study is an .economical and feasible extenskon of the facilities of the district. d. In, the event it is determined that the facilities to be 27 1 constrrlcted constitute a portien of the primary distribution system of the district or any Improvement District the 28 I following procedure shall be followed: I I 30 29 1 31 32 I I 1. The applicant shall deposit with the district an amount of money equal to the estimate of rea- sonable cost of cons-truciing said facilities as estimated by the District Engineer in the pre- liminary design study. 2. Thereafter the District Engineer shall prepare I1 a -7 v. 1 2 detailed plans and specifications for the construction .of said facilities which shall be submitted tothe Board of Directors of the district for appr.ova1, ',I 3 4 5, 6 7 8 9 10 11 12 e. 13 I 14 15 I 16 17 18 19 3. After approval of said plans and specifications by the district the said facilities shall be constructed by the district in accordance with its normal procedure for construction of district projects. 4. All expenses of constructing said facilities, including incidental costs, shall be paid by the applicant and in the event any deposits paid by the Applicant .are insufficient to cover all of s.aid cos$, the Applicant shall, upon request, immediately deposit with the district any -additional monies nemss.ary. ,In the event the s.aid costs of constructing said facilties are less than the deposit of the Applicant any excess m,onies shall be refunded to the Applicant. In the event it is determined that the facilities to be constructc do not constitute a portion of the primary distribution system the district or any Improvement District the following procedt shall be followed: 1. The Applicant shall have detailed p1an.s and specifications for the construction of said facilities, prepared at his expense, and submitted to the District Engineer for his review and recommendation to th e Board of Directors of the. district. At such time the Applicant shall deposit wit1 the District sufficient funds for the engineering review by the District Engineer; the .amount of the deposit to be determined by the. District Engineer. ' 2. After the review of said plans and specifications the District Engine.er shall s-ubmit his report and 'recorn-' mendations on said plans to the B.oard of Directors of the district for approval. 20 3. After approval of said plans and specifications by the 21 22 23 24 25 26 27 district and prior to commencement of construction the Applicant shall depsit with the district sufficient funds for the' costs of reasonable and ,necessary inspections by the district's representative;: the amount of the deposii to be determined by the District Engineer. 4. Prior to commencement of construction the Applicant shall give notice to the District forty-eight hours prior to the commencement of any work. SECTION 2. EFFECTIVE DATE:, This ordinance. shall take effect and i force 011 the thirty-first day from and after its final pass.age.
