ORDINANCE NO. 28 AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE COSTA REAL MUNICIPAL WATER DISTRICT RELATING TO WATER CONSERVATION The Board of Directors of the Costa Real Municipal District does ordain as follows: SECTION 1 : The Board of Directors hereby establishes a comprehl water conservation plan, which shall be added to the Admix tive Code of the District to read: .I I ARTICLE 9. WATER CONSERVATION Section 9.1. Declaration of Policy Relatinq to Water cc vation The conditions prevailing in the area served by the Cost Municipal Water District require that the water res available to the District be put to the maximum benefici to the extent to which they are capable, and that the wa unreasonable use, or unreasonable method,of use of wa prevented and the conservation of such water is to be ez with a view to the reasonable and beneficial use thereof, Section. 9 . 2 . Authorization. The General Manager or his designate, upon adoption Directors of the District, of a resolution following a hearing, is hereby authorized and directed to impleme applicable provisions of this Ordinance as necessary to I the public welfare and safety. Section 9.3. Application. The provisions of this Ordinance shall apply to all pe customers, and property served by the District whereve uated. Section 9.4. Water Conservation Stages. No customer of the District shall knowingly make, causc or permit the use of water from the District for reside commercial, industrial, agricultural, governmental, other purpose in a manner contrary to any provision c Ordinance, or in an amount in excess of that use permit the following conservation stages which are in effect PI 1 I I 1 to action taken by the General Manager, or his designa accordance with the provisions of this Ordinance. Stage 1 applies during periods when a normal supp distribution capacity is available, while at the sarr demand levels are not expected to significantly incre the immediate future. Stage 1 reiterates existing Di regulations. Elements of a Stage 1 include: (1) Implementation of the District's Urban Wate agement Plan and Conservation Program. (2) Adoption of a District Policy which is an Plan for Implementation of Water Conser Techniques. (3) Failure to repair a controllable leak is C as "waste of water" and is prohibited. (b) Stage 2. Mandatory Compliance-Water Alert. Stage 2 applies during periods when the anticipated C of the District are expected to exceed the available to the extent that peak demands may not be met. EXCEPTION: Commercial farms, properties wh: currently being billed by the City of Carl: the agricultural water rate, and commc 2 nurseries, are exempt from Stage 2 irri restrictions but will be requested to curta: nonessential water used. (2) The washing of automobiles, trucks, tra boats, airplanes, and other types of n, equipment, unless wash water is recycl reclaimed wastewater is used, is prohibited on designated irrigation days between the ho 6:OO p.m. and 11:OO a.m. Such washing, allowed, shall be done with a hand-held buc a hand-held hose equipped with a positive s nozzle for quick rinses. (4) The watering of. all golf course areas, greens,. is prohibited unless done with rec wastewater. Irrigation of golf greens shal: only between the hours of 11:OO p.m. and 6: unless done with reclaimed wastewater. Mandatory Conservation Phase Implementatia (a) District staff shall monitor the projected supp demand for water by its customers on aldaily basis c periods of emergency or drought and shall recommend General Manager the extent of the conservation re( through the implementation and/or termination of part conservation stages in order for the District to pru plan for and supply water to its customers. (b) Thereafter, the General Manager shall recommen the appropriate phase of water conservation be imple or terminated in accordance with the applicable pro\ of this Section. He/She is hereby authorized to p' notice of a public hearing as required by law, to be k the Board to consider increasing restrictions on wate: (c) The Board of Directors, upon completion of the hearing, shall adopt a resolution declaring the conservation stage in effect, and specify any ha exemptions which shall be permitted. The Board shall the General Manager to issue an order in accordanc such resolution. Said order shall be made by announcement and shall be published a minimum of c time in a daily newspaper of general circulation and continue tobe published onadailybasis until such1 all restrictions are removed and shall become eff immediately upon such publication. 6 Section 9.6. Penalty. I From and after the publication or posting of this ordil whichever is earlier, any person using or applying received from this District contrary to or in violation restriction or prohibition specified herein shall be pu by imprisonment in County jail for not more than 30 days, a fine not exceeding $600, or by both. SECTION 2: This Ordinance shall take effect and be in force up1 passage, and shall be published in full text within te days, as required by law.
