ORDINANCE NO. 40
ORDINANCE OF THE CARLSBAD MUNICIPAL WATER DISTRICT REPEALING ORDINANCE NO. 29 AND ESTABLISHING FEES FOR ENGINEERING SERVICES
WHEREAS, the Carlsbad Municipal Water District pr
engineering services to the public in connection wit
development of real property within the District; and
WHEREAS, such engineering services include the revi
approval of potable water, reclaimed water, and sewer facil
including main line and lateral installation, replacemel
relocations in connection with the developmental review proc
the City of Carlsbad; and
WHEREAS, the Carlsbad Municipal Water District ha
collecting fees from developers based upon the estimated c
the engineering services for potable water facilities per Ord
No. 29, Section 9.2; and
WHEREAS, the District has estimated, based or
experience, the actual cost of providing engineering plan ch
services for projects of various sizes; a summary c
information on whi.ch this estimate is based has been availa
the public for not less that ten (10) days;
NOW, THEREFORE, BE IT ORDAINED by the Board of Dir
of the Carlsbad Municipal Water District as follows:

replacement and relocation in connection with the develop
review process of the City of Carlsbad;
1. Policy. The Engineering Department shall p
plan checking services for potable and reclaimed water and
facilities services to be constructed and added to the syst
the City and the District at a charge of estimated c(
providing such services.
2. Fees. The fees shall be charged based UF
estimated construction costs of the potable, reclaimed and
systems only, as determined by the District Engineer (
designee upon review of the plans submitted in connection wj
type of development within the City and the District. The
fees shall be established by resolution of the Board of Dir
of the District.
SECTION 111: Adiustment of Fees by Resolution.
District shall periodically review the fees charged for engir
services to insure that the fixed fees do not exceed the est
costs of providing the services, and are fair and appror

resolution.
SECTION IV: When Paid. Fees shall be payabl
submission of plans for plan check, and prior to completion (
check and approval of plans by the District Engineer.
EFFECTIVE DATE: This Ordinance shall be effective
days after its adoption, and the Secretary shall certify
adoption of this ordinance and cause it to be published at
once in the Carlsbad Journal within fifteen days aft(
adoption.
