HomeMy WebLinkAboutAgua Hedionda Lagoon Foundation; 2009-10-20;Citv of Carlsbad Planning Department October 20, 2009 Agua Hedionda Lagoon Foundation Attn: Eric Munoz 1580 Cannon Road Carisbad, CA 92008 RECEIVED NOV 1 7 2009 CITY OF CARLSBAD PLANNING DEPT SUBJECT: AGP 06-13 - AGRICULTURAL CONVERSION MITIGATION FEE GRANT FUNDING AGREEMENT Dear Mr. Munoz, On February 19, 2008, the Carlsbad City Council approved the Agricultural Conversion Mitigation Fee Ad Hoc Citizens Committee's recommendation to encumber your organization's entire funding request of $305,750 in Agricultural Conversion Mitigation Fee Grant funding. The funding is awarded for Agricultural Conversion Mitigation Fee Grant Project (AGP) 06-13 (Agua Hedionda Lagoon Trails), for maintenance and construction of trails around Agua Hedionda Lagoon. A copy of City Council Resolution No. 2008-050, which approves the allocation of grant funding, is enclosed for your information. This letter is to serve as a Letter of Agreement for disbursement of $35,000 in grant funding from the Agricultural Conversion Mitigation Fee Grant Fund to implement a portion of Module I only. Disbursement of the balance of funds to complete implementation of Module I, as well as to implement Modules II and III will be subject to execution of a subsequent funding agreement, which includes an updated project budget and schedule. All persons who signed the grant application must sign this agreement. Please return the signed agreement along with: 1) the attached Annual Solicitation (Substitute W-9 Form), and 2) an updated project budget and schedule that describes the work tasks, estimated cost, completion dates and disbursement schedule for those portions of the grant to be funded with the first $35,000 of awarded grant funding. Since implementation of the project will occur in phases (referred to in the grant application as modules) and funding disbursements will be made in increments, the project budget and schedule must detail said phases/increments and indicate the funding amounts and anticipated timing for each incremental disbursement. Upon receipt of the aforementioned materials, City staff will fon/vard the Agreement to the Mayor for signature. Once the agreement has been signed by the applicants and the Mayor, staff will begin the initial release of funds according to the approved funding schedule. Failure to implement any component ofthe project will result in project reconsideration and possible cessation of funding. In addition, if funds are not spent for their specific purpose, they must be returned to the City. If you need to make changes in your project or schedule, please contact the Planning Department. Grant recipients are required to recognize on alt printed material that the project is funded in part or in full by the City of Carisbad. In addition, the grant recipient agrees to maintain original records (i.e., receipts) for at least five years from the date on which final grant funds are disbursed and agrees to make them available to the City should the City request to audit them. In October 2006, an MOU was executed between Cabrillo Power and the AHLF whereby AHLF accepted an easement for the North Shore "Hubbs Trail." • Removal of all non-native, invasive weeds from the North Shore (aka Hubbs Trail) • Installation of additional trash and recycling bins • Design, manufacturing and installation of additional trail regulation signs 1.2 Discovery Center/DFG trail improvements November 2009 $20,000 Note: This trail is officially a DFG trail however, DFG is not maintaining the trail due to a lack of resources. The AHLF has the permission and cooperation of DFG in our maintenance efforts of this trail. Overview: To reduce weeds and mud on trail by applying a safe base material over the needed areas along trail • Removal and disposal of non-native vegetation and trimming back native vegetation. • Evenly grade trail to remove irregularities and enhance drainage. • Deliver decomposed granite • Apply decomposed granite, stabilize and compact. •' Design and install interpretive signage 1.3 Ongoing Maintenance Years 1-5 TBD $9,750 • Removal of non-native vegetation and trimming back of native vegetation, as necessary. • Replacement of damaged signage as necessary. • Replacement of vandalized or stolen benches and trash and recycling containers, as necessary. Module II - 2.0 Trail System Maintenance, Years 5-10 TBD $111,000 • Our original plans to maintain up to 10 total miles of trails in years 6-10 have not changed at this time. Specific milestones and action plan details will be solidified at a later date and we will update the project schedule at that time. At this point in time, we do not anticipate Module II costing more than the approved amount of$l 11,000. i 3.0 Trail Construction Years 6-10 TBD $150,000 • Our original plans to construct up to 5 miles of trails (if not constructed by others) have not changed. Specific milestones and action plan details will be solidified at a later date and we will update the project schedule at that time.
