Subject: Carlsbad Tract 73-49 .--Palomar Airpo~t Business Park, Unit No. 2
Gentlemen:

· By agreement dated November 3, 19]6, the undefsigned, acting as successors
of CC&F Palomar Properties, Inc., a California corporation, have a contrac-
tual obligation to construct all of the public water system facilities in
the ~subject subdivision in accordance with the plans and specifications as
approved by the Water District. Reference is made to the agreement for all
of the specific terms and conditions.
In view of ·.circumstances which have been mutually recognized by both we as
t h e II S u b d. i v i d e r II a n d t h e W a t e r D i s t r i c t , c o n s t r u c t i o n w o r k h a s b e e n d e l a y e d ;
however, at this time, we are now prepared to proceed with the actual con-
struction work on the site. Accordingly, we request that you consider two
·modifications to the original . agreement of November 3, 1976, as follows:
1) Under Section 3, on Page 2, the Di .strict has estimated the expenses
of the District in the amount of $6,000.00 to cover all of the
activities for construction inspection, contract administration,
and other such expenses. In view of the increases in the cost of
such activities, we shall increase this ~otal cash deposit to
$10,000.00, and will remit to you an additional .$4,000.00 which,
together with the original $6~000.00, will constitute the full cash deposit.
2) Under Section 9, on Page 4, we have originally estimated the cost
of the construction project in the amount of $138,000.00, and we
have previously furnished to you a financial guarantee in the form
of a surety bond in that amount. In view of the increased costs
of construction, we have determined a new total do.llar value of
$210,000.00, and we shall furnish to you a second financial
guarantee in the amount of $72,000.00.
If agreeable with you, this letter shall constitute a supplement to our
original agreement.of November 3, 1976, and we will accept your concurrence
by signature to this letter agreement. '
