SUBJECT: AGRICULTURAL CONVERSION MITIGATION FEE GRANT
FUNDING AGREEMENT
I am pleased to inform you that the Carlsbad City Coimcil approved the Agricultural
Conversion Mitigation Fee Ad Hoc Citizens Committee's recommendation that you/your
organization receive $1,500,000.00 in Agricultural Conversion Mitigation Fee Grant funding.
The grant fimding is to be used for the following purpose(s): feasibility study and
preliminary design, environmental documentation, agency permits, final plans and
spec's, and pre-and post-project monitoring activities as described in your Grant
Proposal No. AGP 06-10 - Carlsbad Beacli Nourishment.
This letter is to serve as a Letter of Agreement. The grant funds will be awarded in phases
and upon the achievement of milestones according to the attached project schedule. Any
project that is awarded funds will be required to meet agreed-upon milestones. (Some
projects will be a single-phase project.) If you need to make changes in your grant proposal
project or schedule, please contact the Plarming Department. Please have both of the people
who signed the grant application sign this agreement and retum it in the enclosed envelope.
City staff will then forward the letter to the Mayor for signature. Once the agreement has
been signed by the applicants and the mayor, we will begin the initial release of funds
according to the approved milestone/funding schedule. If the funds are not spent for this
specific purpose, they must be retumed to the City. In addition, failure to satisfy the agreed-
upon milestones will result in project reconsideration and possible cessation of fimding.
Grant recipients are required to recognize on all printed material that the project is funded in
part or in full by the City of Carlsbad.
A final report on how the funds were spent and what the project accomplished must be filed
with the City of Carlsbad once the funds are spent or within one year of receipt of the money,
whichever comes first. In addition, you agree to maintain original records (i.e., receipts) for
at least five years from the date on which you receive your final grant funds and make
them available to the City should they request to audit them.

BEACH NOURISHMENT PROJECT
This is a follow-up to our conversation yesterday regarding the payment of an invoice from
SANDAG for preliminary work on the next Regional Beach Sand Project and the potential for
future funding draws for the Carlsbad Beach Preservation Committee/SANDAG Beach
Nourishment Project.
Recently the city received an invoice from SANDAG to cover preliminary planning activities,
including preliminary engineering and off shore sand investigations. On November 6, 2007 the
City Council approved Resolution No 2007-288 authorizing a Memorandum of Understanding
(MOU) with SANDAG to pay a share of the next Regional Beach Sand Project and committing to
fund the initial efforts at a cost of $74,500 from the approved Agriculture Conversion Mitigation
Fund. Staff is recommending the Planning Department process the invoice for payment. The
approved resolution, related City Council Agenda Bill 19,216, and the signed MOU are attached.
In 2007, the City Council approved the Carlsbad Beach Preservation Committee's request for a
$1.5 million Agricultural Conversion Mitigation Fund grant (proposal AGP 06-10 - Carlsbad
Beach Nourishment) to implement a stand-alone beach nourishment project benefitting Carlsbad
beaches only. The Regional Beach Sand Project, with regards to its Carlsbad component, is
similar to and would accomplish the same benefits as the Carlsbad Beach Nourishment project.
Recognizing the worthiness of the regional project, the City Council in Resolution 2007-288 (1)
states it is appropriate and beneficial to join the region-wide effort and implement beach sand
replenishment as part of a regional, rather than local only, project and, accordingly, (2) allocates
$74,500 from the Agricultural Conversion Mitigation Funds to provide Carlsbad's prorated share
of the planning activities for the next Regional Beach Sand Project.
Also, as this project moves forward, additional funding requests will be necessary to cover
expenses for the final design, development of a project EIR, resource agency permitting,
biological monitoring efforts, and development of the project plans and construction documents.
These are all components of the approved AGP 06-10.
At this time SANDAG has not finalized costs for these future efforts; detailed cost determinations
will be made as the project moves forward. Staff will then request future funding allocations
from the approved Agricultural Conversion Mitigation Fund grant as the costs become finalized;
this future funding from the approve grant was anticipated in the Agenda Bill 19,216 Fiscal
Impact section. In any event, the allocation requests will not exceed the approved Agriculture
Conversion Mitigation Funding previously authorized for the Beach Nourishment Project as
approved as part of AGP 06-10.
Furthermore, it is anticipated that the overall project schedule, while containing the milestones
outlined in AGP 06-10, will result in beach sand deposition at the end of 2011. This represents a
delay in the approved schedule that is due to the participation in a regional, rather than Carlsbad-
only, program.
Finally, consistent with the requirements of the approved Agricultural Conversion Mitigation
Fund grant, the signed MOU states SANDAG agrees to retain the original records for at least 5
years from the date of project completion and make them available to the City of Carlsbad upon
request.
