THIS AGREEMENT, MADE AND ENTERED INTO THIS
21st DAY OF November , 1978
BY AND BETWEEN
CARLSBAD MUNICIPAL WATER
DISTRICT, hereinafter referred
to as "OWNER"
AND
STATE OF CALIFORNIA
acting by and through its
Business and Transportation Agency,
Department of Transportation,
hereinafter referred to as "STATE"
WITNESSETH
WHEREAS, STATE on November 13, 1951 adopted the route of
ll-SD-78 between Oceanside and Vista,
and
WHEREAS, STATE contemplates construction by contract a
revision of the El Camino Real Interchange on Route 78 in the near
future,
and

WHEREAS, the improvement will require the widening of the
two existing bridges,
and
WHEREAS, OWNER has requested STATE to include provisions
in STATE'S contract for the installation of two welded steel casings
for two water mains within the two structures,
and
WHEREAS, STATE is willing to provide the openings and in-
stall hangers and two casings within the two structures,
and
WHEREAS, OWNER will furnish plans, specifications and
all material required for the installation of the hangers and two
steel casings.
NOW, THEREFORE, in consideration of the covenants and con-
ditions herein contained, the parties hereto agree as follows:
SECTION I
STATE AGREES:
To provide the openings and cause to be installed under STATE'S
contract the two steel casings and hangers, in accordance with
plans and specifications submitted by OWNER.
SECTION II
OWNER AGREES:
A. To furnish plans and all required material for the hangers
and two steel casings within the structures and to bear
the actual cost of the installation, plus 10% for the
STATE'S overhead expenses. It is estimated that OWNER'S
for installation of the hangers and two steel casings is
$6,260 + 10% = $6,886.00. The actual cost to OWNER for
the installation will be determined on the bid price and
the final contract quantities on completion of the contract

B. To deposit with STATE the sura of $6,886.00 within 30 days
after advertisement of the project and upon receipt of
STATE'S demand; said sum being the estimated total cost
of the work hereinbefore described as to be borne by
OWNER.
In the event the actual cost is less than said deposit,
STATE will refund the difference between the actual cost
and the amount of the deposit by OWNER. In the event
the actual work exceeds said deposit, STATE will bill the
OWNER the difference between the amount of said deposit
and the actual cost of OWNER'S share.
SECTION III
OWNERSHIP:
Upon completion of the work to be done by STATE in accordance
with the above mentioned plans and specifications, the new
facilities shall become the property of OWNER, and OWNER shall
have the same rights in the new location that it had in the
old location.
OWNER shall submit a Notice of Completion to the District
Utilities Engineer within 30 days of the completion of the
work described herein.

IN WITNESS WHEREOF, the parties hereto have caused this
Agreement to be executed by their respective officers, duly
authorized, the provisions of which Agreement are effective as of
the day, month and year first hereinabove written.

NEGATIVE DECLARATION
THE PROPOSED CONSTRUCTION OF
OCEANSIDE/CARLSBAD INTER-TIE II
BY THE
CARLSBAD MUNICIPAL WATER DISTRICT
DESCRIPTION OF PROJECT:
Proposed construction would consist of a twelve-inch (12") ductile iron
main for the future use of transporting "non-potable" water and a fourteen-
inch (14") ductile iron main for the transmission of "potable" water sup-
plies for Oceanside and Carlsbad.
The mains would only be installed in the bridge structure widening and
capped on each end. Future connections' of the new "potable" water system
to existing water systems and future extension and use of the "non-potable"
water system would require additional environmental assessments.
The proposed fourteen-inch main in conjunction with a similar sixteen-inch
(16") water main installed in 1974 during a previous bridge widening is
intended to suffice as an emergency inter-tie between the two cities and to
replace an old eighteen-inch (18") ductile iron water main which existed
under Route 78 for the transmission of water from the San Luis Rey River
well fields in Oceanside to the community of Carlsbad.
LOCATION OF PROJECT:
The site is generally on the boundary common to the Carlsbad Municipal,
Water District and the City of Oceanside, though all physical construction
will take place in the City of Oceanside.
Proposed construction would occur within the proposed bridge widenings where
El Camino Real crosses State Route 78 and the Buena Vista Creek Flood Control
Channel.
FINDINGS OF THE DISTRICT:
On the basis of the "Initial Study of the Proposed Construction of Oceanside/
Carlsbad Inter-Tie 11" and District staff evaluations, the Board of Directors
,of the Carlsbad Municipal Water District have made a finding that the pro-
posed construction of said Inter-Tie II will not have a significant affect
on the envi ronment.
