THIS AGREEMENT, made and entered into this--~!~-day of
_ July ______ , 198j!_, by and between COSTA REAL MUNICIPAL WATER
DISTRICT, hereinafter referred to as "District" and
T.B. Gorton Construction Co. , hereinafter referred to as
"Contractor."
WITNESSETH:
1. Contractor shall, under the direction and to the
satisfaction of District, furnish all labor, materials,
equipment, transporation and services for:
CONSTRUCTION OF CALAVERA HILLS PUMP STATION
AND PRV VAULT IMPROVEMENTS
in the principal sum of $ 343 470-in accordance
with the plans and contract specifications documents, all of
which are incorporated herein by reference and made a part
hereof.
2. Contractor shall pay to any laborer, mechanic or apprentice
employed, the prevailing rate of hourly wages and rates for
legal holidays, overtime work3 and standard apprentice wages
as set forth in the Advertisement for Bids and keep adequate
records thereof. Contractor shall, accordingly, pay as a
penalty to the District the sum of up to One Hundred Dollars
($100.00) for each calendar day or portion thereof for each
workman paid less than the prevailing and standard wage
under this contract, by Contractor and/or any sub-
contractor.
3. Contractor shall commence construction within ten (10)
calendar days from receipt of Notice to Proceed and pursue
said work in a diligent and workmanlike manner without

4. District agrees to pay and Contractor agrees to accept
proportionate payments as work progresses according to
specification, subject to additions and deductions provided
therein, all in accordance with the applicable provisions of
Standard Specifications for Public Works Construction which
sums sha 11 be computed for the prices set forth in the bid
submitted by the Contractor.
5. The Contractor will commence the work required hereunder
when required by the Notice to Proceed, and shal 1 complete
the work within the following times thereafter:

The Contractor agrees to pay as liquidated damages, the sum
of $300.00 for each consecutive calendar day after the
stipulated completion date(s) that the work remains
uncompleted.
This agreement shall be binding upon all
their respective heirs, executors,
successors, and assigns, but shall not be
