RESOLUTION OF THE CARLSBAD HOUSING AND REDEVELOPMENT COMMISSION AMENDING SECTION
AND REDEVELOPMENT COMMISSION.

”- BKKGROUW: As a result of an inquiry from the Chairman of the Housing and Redevelopment
process for payment, of bills is proposed to be amended. The proposal will

eliminate the necessity of having bills ratified by the Commission by transfering that responsibility to the City Council. In addition, the amendment will
clarify.the manner in which demands for payment are to be processed by
formally adopting the City’s warrant procedure.
The proposed amendment was reviewed by the Carlsbad Housing and Redevelopment Advisory Committee on August 25, 1980 and recommended for Commis*.ion approval
by a vote of 6-0 with members Mariz, Runzo and Hayes absent.
Attachment 1 shows the existing by-law wording as well as that proposed by the
amendment resolution.

WEREAS, the Cit.y of Carlsb?d ha: established the Carlsbad Housing and
Rcdc.ve'!oprne,lt Co;!mission, pl;rsuan'i t.o the provisions of the California Health
and Safety Code; and
WHEREAS, the City Counci 1 has declared itself to be the Carlsbad Housing

and Redevelopment Comnission, in accordance with the provis'ions of such Code;
and
WHEREAS, the Commission established By-Caws to ca-ry into effect the
powers, purposes, anti funds, of the Conmission adopting Commission Resolution
No. 1, and
WHEREAS, the Commission finds it desirable to amend its By-Laws for the
purpose o-f sirnpiifying the payment OF Cornrn.ission bills,
NO!$, THERCFONE, i3r: IT RFSOLVED by the Carlsbad Housing and Redevelopment
Comnissior~ as follows:
1. That the above recitatiocs are true and correct
2. That the Carlsbad Housing and Redevelopment Colnniission does hereby
amend Section 403 of its By-law referring t.0
"Payment of Money, Flotes, or other Indebtdness ," to read as shown in
Exhibit A attached hereto and incorporated hy refe'rence.
BE IT FURTHER RESOLVED THAT Section 506, Order of Business;is hereby
3nerided by delct,ing item! (3) "payment of bills" and removing all itern numbers
as shown in Exhibit B attach2d herel.0.

GENERAL
(EXISTING)
Section 403: Payment of Yoney, Notes or other Indebtdness: All checks, drafts,
or other orders for the payment of money, notes or other evidence of indebtdness issued in the name of or payable to the commission shall be signed or endorsed by such person or persons and in such a manner as from time-to-time shall be determined by the members of the commission.

ARTICLE IV, GENERAL SECTION 403,
PAYMENT OF MONEY, NOTES OR OTHER
INDEBTEDNESS
All checks, drafts, or other orders for payment of money, notes, or other
evidence of indebtdness issued in the name of or payable to the Commission
shall be processed in the same manner as provided in the Carlsbad Municipal
Code (3.32.0.0 - .020), with the exception that the Finance Director in his
role as Commission Treasurer shall perform all duties, which under such code,
are assigned to the City Treasurer.
The bills of the Commission shall be ratified by the City Council at the same
time and in the same manner as those of the City of Carlsbad.
