RECOMMENDED ACTION:
The Land Use planning staff recommends that the Housing and Redevelopment Commission adopt attached Resolution No. 029 directing staff to file an application with the State Coastal Commission for an amendment of the Carlsbad Local Coastal Plan in the Redevelopment Area.
ITEM EXPLANATION
This item is a City request to initiate an amendment to the Carlsbad Local Coastal Plan to make the plan consistent with the City's Village Redevelopment Plan. The proposed amendment was reviewed in concept at a joint City Council and Design Review Board meeting held on April 12, 1983. The proposal has also been reviewed by the Housing and Redevelopment Advisory Committee which unanimously recommended its approval.
The proposed amendment would bring the Carlsbad Local Coastal Plan and the City's plan for the Village Redevelopment Area into conformance. As a result, it would allow for the construction of previously approved office project on the south side of Elm Avenue between Carlsbad Boulevard and Washington Street that was enthusiastically supported by the Redevelopment Advisory Committee and the Housing and Redevelopment Commission.
The construction of the project is presently being delayed as there is an inconsistency between the land use designated for the property in the City's Village Redevelopment Plan (General Commercial) and the land use indicated on the Local Coastal Plan (Visitor Commerical). Discussion with staff from the Coastal Commission has indicated that rather than receiving a request from the applicant to amend the Local Coastal Plan just for this individual property, they would be more favorably inclined if a more comprehensive proposal supported by the City was submitted which addressed the entire Redevelopment Area and provided justification from a land use standpoint for redesignating the Coastal Plan areas. Coastal staff believes that this justification can be provided by City staff.
The Land Use Planning staff feels that proposed changes to the Local Coastal Plan can be justified for the following reasons:
1. Major points of disagreement between the City and the Coastal Commission (ie., agriculture, steep slopes) are not issues in Redevelopment Area.

2. The City has redesignated other properties within coastal zone along I-5 corridor (ie., Palomar Airport Road and I-5, Poinsettia and I-5) for travel/visitor service commercial which greatly exceed the properties that would be deleted from these uses in the Redevelopment Area.
3. It would eliminate potential obstacles to implementing the Redevelopment Plan.
4. The Housing and Redevelopment Commission is trying to encourage/facilitate good development in the Village Area with minimal procedural difficulty.
Attached for the Commission's review is a map and a summary of the present inconsistencies (Exhibits "A-B" of draft letter) between the Redevelopment Plan and the Local Coastal Plan. Also attached is a draft ietter to the Coastal Commisson providing more detailed information justifying the amendment.

ENVIRONMENTAL REVIEW
A Negative Declaration was approved by the Land Use Planning Manager in compliance with the City's Environmental Protection Ordinance indicating that this proposal would not have a significant impact on the environment.

8 WHEREAS, the above mentioned discrepancies have delayed
9 the development of a project that has been enthusiastically
10 supported by the Housing and Redevelopment Commission (City
- 11 Council); and
12 WHEREAS, the City feels the project will greatly enhance L
13 the Redevelopment Area and will stimulate additional redevelopment;
14 and /I
15 WHEREAS, other projects in the Redevelopment Area may
16 also be delayed because of these discrepancies; and
17 . WHEREAS, the City has redesignated other properties
18 within the coastal zone along the Interstate 5 corridor for
19 (travel/visitor service commercial which greatly exceed the amount I
20 that would be deleted from the Redevelopment Area; and
21 WHEREAS, the proposed amendment would eliminate all
22 potential obstacles to implementing the Carlsbad Village
23 Redevelopment Plan; and
24. WHEREAS; the Housing and Redevelopment Commission is
25 trying to encourage and facilitate good development in the Village
26 Area with minimal procedural difficulty; and

WHEREAS, said amendment to the Carlsbad Local Coastal Plan
has been declared to have a nonsignificant impact on the
environment and a Negative Declaration has'been prepared and filed
in compliance with the requirements ,of the City of Carlsbad's
Environmental Protection Ordinance of 1972.'
II . NOW, THEREFORE, BE IT RESOLVED by the Housing and
Redevelopment Commission of the City of Carlsbad as follows:
II 1) That the above recitations are true and correct.
2) That the Land'Use Planning Staff is hereby directed to submit a proposal to the California Coastal Commission for an amendment to the Carlsbad Local Coastal Plan in the Carlsbad Village Redevelopment Area as shown on Exhibits A & B dated June 3,
1983 incorporated by reference and on file in the Land Use Planning Office.

Area 1
South side of Elm between Carlsbad Boulevard and Washington Street - The LCP designates this area for visitor commercial, Redevelopment Plan indicates general . . commercial. The City would like to amend the LCP to allow general commercial in this area.

East side of Carlsbad Boulevard north of the Army-Navy Academy athletic field - There is no specific land use designation for this area in the LCP. The Redevelopment Plan indicates travel services commercial: The City would like to have this area designated for visitor commercial by the LCP.
Area 3
North side of Elm Avenue between the AT & SF Railroad and Madison Street. The LCP designation for this area is General Commercial. In addition to the General Commercial the Carlsbad Village Area Redevelopment Plan allows for consideration of residential uses. The City would like to amend the LCP to allow for the consideration of residential uses in this area.
