ITEM EXPLANATION: A public hearing for RP 84-l was held by the Design Review Board at their meeting of February 27, 1984. The applicant is requesting a permit for the Twin Inns. The project will encompass the entire block surrounded by Carlsbad Boulevard, Washington Street, Grand and Elm Avenues with the exception of the existing doctor's office and Fisherman's Supply store on the northwest corner of the block. The existing Twin Inns restaurant building will be refurbished. 163 hotel units will be constructed in a three story building around the perimeter of the property. These buildings will conform with the 35' height limitation. A banquet room and clubhouse facility will be located at the southeast corner of the property. Approximately 11,000 square feet of retail space is proposed on the first floor of the building fronting on Grand Avenue. The Design Review Board, with two members disqualifying themselves, voted two to one in favor of AP'PROVI'NG RP 84-l. The negative vote being based on dissatisfaction with the architecture. The Commission is asked to adopt Resolution No. 036"APPROVI'NG RP 84-l. FISCAL IMPACT: This action will result in no fiscal impact to the City. ' SUPPLEMENTAL STAFF REPORT March 12, 1984 TO: CITY MANAGER FROM: Community Redevelopment Manager RP 84-l TWIN INNS PROPOSAL - DRB MEETING Re: Recommendation change from DENIAL (attached Staff Report) to APPROVAL with conditions (Resolution No. 036 attached). RP 84-l (Twin Inns) was sent to the Design Review Board for public hearing on February 22, 1984 with the attached staff report recommending denial. At the meeting four of the five Design Review Board members were present. Two members disqualified themselves from the review process on this project. This resulted in a lack of a quorum for this item. The public hearing for the Twin Inns was reset for February 27, 1984. Meanwhile, intensive negotiations were being held with the applicant and City staff to resolve the problems with the project. By the second meeting a revised site plan was presented and deemed acceptable to staff with the conditions contained in Resolution No. 036 (exhibit 3). Significant changes from the original plan included the creation of an off-site leased parking lot, no utilization of Rotary Park and a new circulation plan. Total number parking spaces proposed were 288 out of the 309 that code requires. The Design Review Board voted to forward the project to the Housing and Redevelopment Commission recommending approval. The vote was two in favor, one opposed. STAFF REPORT February 22, 1984 Design Review Board Land Use Planning Office RP 84-1 - TWIN INNS - Request for a Redevelopment Permit to refurbish the Twin Inns restaurant, construct 161 hotel units and 11,025 square feet of retail space on property surrounded by Carlsbad Boulevard, Elm Avenue, Grand Avenue and Washington Street in Sub-area 5 of the V-R zone. RECOMMENDATION It is recommended that the Design Review Board ADOPT Resolution No. 030 recommending DENIAL of RP 84-l to the Housing and Redevelopment Commissionsed on the findings contained therein. II. PROJECT DESCRIPTION The applicant is requesting a Redevelopment Permit for the Twin Inns property located as described above. The project will encompass the entire block bounded by Carlsbad Boulevard, Washington Street, Grand and Elm Avenues with the exception of the existing doctor's office and tackle shop on the northwest corner of the block. This site has an area of 3.66 acres. The majority of the property is vacant at the present time except for the portion occupied by the Twin Inn buildings and its parking lot. The existing Twin Inns restaurant will be refurbished and a portion of it will be used as a check-in office for the hotel portion of the project. One hundred sixty-one hotel units will be located in a three story building which will be constructed around the perimeter of the property and down the middle of the project. These buildings will not exceed a height limit of 35 feet as defined by the City's ordinance. A banquet room and clubhouse facility for guests staying at the hotel will be located at the southeast corner of the property. Approximately 11,000 square feet of retail space is being proposed on the first floor of the portion of the building fronting on Grand Avenue. As shown by the site plan, the project will be oriented inwards around two central courtyards. One of the courtyards will have a swimming pool and spa while the other will have two tennis courts and a large grassy area. One hundred fifty-two parking spaces will be located in an underground parking garage. People will be able to obtain access to and from this garage from Carlsbad Boulevard or Washington Avenue. 4 The applicant proposes an additional eighty parking spaces along both sides of Washington Street. These parking spaces would eliminate a large portion of Rotary Park and require that the applicant obtain a lease from the AT&SF Railroad to use this property for- parking. The applicant is also requesting that the City vacate Washington Street since it will essentially become a driveway for the project parking. If the City vacates Washington Street it will become a one way private driveway from Elm Avenue to Grand Avenue. The project as proposed would necessitate the relocation of the North County Transit District bus stop from its present site adjacent to the property on Grand Avenue. III. ANALYSIS Plannina Issues 1) Does the proposed project conform with the requirements of the Zoning Ordinance? 2) Does the proposed project conform with the goals of Sub- area 5 of the Village Redevelopment Area? Discussion This staff report is based on a rapid review of a revised site plan that was submitted on Friday, February 17, 1984. There is a possibility that other problems may exist, but staff has not had the time to fully review the revised plan. Staff believes that this project should be scheduled for a later hearing date, but the applicant wished to have the project presented at this hearing. At this time there are a number of Planning and Engineering concerns that have not been resolved. Staff can not recommend approval of this project until these items are resolved. As mentioned previously, this project is proposing the use of Washington Street as a private driveway to provide access to surface and subterranean parking. This would require that the City vacate Washington Street as a public street. Staff believes that Washington Street is an integral part of the downtown area traffic circulation system. East bound traffic on Grand Avenue, particularly buses, now using Washington Street to gain access to Elm Avenue would be shifted to State Street. At the present time, State Street has diagonal parking. The City's Traffic Engineer has advised that streets with diagonal parking have an accident rate of two to four times that of streets with parallel parking. Additional traffic, especially buses, will intensify this problem. This additional traffic would also tend to destroy the much devised pedestrian orientation of State Street. -2- This project also proposed a driveway 45 feet to the north of the intersection of Elm Avenue and Carlsbad Boulevard. This driveway is too close to the intersection and poses a hazard to vehicles turning right from Elm Avenue onto Carlsbad Boulevard. As proposed, the parking for this project does not comply with the City's parking requirements even with a 15% reduction for shared parking. According to the plan submitted by the applicant this project is only 10 spaces short. However, a number of the parking spaces in the underground parking garage and parking lot adjacent to the Twin Inns do not comply with City standards and should be eliminated for safety purposes. The landscape plans for this project provide for a minimal amount of landscaping in the parking areas. As normally required staff would recommend that a few planter inslands be provided to break up the long rows of parking, these islands would eliminate a number of parking spaces. In addition, 80 of the required parking spaces for this project are located in the AT&SF Railroad right-of-way (Rotary Park area). All of these parking spaces would be eliminated if the railroad should fail to approve or subsequently renew a lease allowing parking in the railroad right-of-way. Most if not all of these parking concerns could probably be resolved by an expansion of the underground parking garage. In conclusion staff strongly recommends that this project either be denied or the applicant be directed to work with staff and return to the Design Review Board when all of the major issues have been resolved. This site is very important to the City as a whole and to the redevelopment of downtown Carlsbad. Staff feels that given additional time these issues can be resolved. IV. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this project will not have a significant impact on the environment and, therefore, has issued a Negative Declaration on February 10, 1984. The proposed project will be compatible with existing and future tourist commercial uses on adjacent properties. Development shall occur substantially as shown unless otherwise noted in these conditions. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee, a copy of that agreement, dated January 6, 1984, is on file with the City Clerk and incorporated herein by reference. The applicant shall prepare a reproducible mylar of the final site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits. The applicant shall prepare a detailed landscape and irrigatio plan which shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits. All parking lot trees shall be a minimum of 15 gallons in size. A master plan of the existing on site trees shall be provided to the Land Use Planning Manager as part of the final grading plan to determine which trees shall be saved prior to the issuance of a grading permit or a building permit, whichever occurs first. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Land Use Planning Manager prior to installation of such signs. A uniform sign program for this development shall be submitted to the Land Use Planning Manager for his review and approval prior to occupancy of any building. Prior to issuance of a building permit additional trash receptacle areas shall be provided adjacent to the hotel and retail portion of the project. These trash receptacle areas shall be enclosed by a six-foot high masonary wall with gates pursuant to City Standards. All roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from view and the soun buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of th Land Use Planning Manager and Building and Planning Director. The developer and the City shall negotiate with‘ the North County Transit District to try and agree on a relocation of th bus transfer facility presently located on the northern (Grand Avenue) boundary of the project. I/// -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 15) 16) 17) 18) Engineering Landscaped islands shall be installed to breakup the rows of parking along Washington Street and adjacent to the Twin Inns to the satisfaction of the Land Use Planning Manager. Developer shall maintain parking areas on Washington Street side of property and keep free from weeds, trash and debris. This approval shall become null and void if building permits are not issued for hotel and retail portion of the project within one year from the date of project approval. The developer shall provide 41 additional parking spaces off site but in reasonable proximity to the project. The City will use its best efforts to obtain a lease for such parking. Developer shall sublease the parking spaces from City and assume allof City's obligations under the lease. Prior to issuance of a building permit the applicant shall provide a site plan acceptable to the City showing how the proposed parking located off site can be provided on site. The developer shall agree to provide the additional parking spaces if the lease cannot be obtained or if the lease at that site expires or is terminated for any reason. The additional parking spaces shall be leased or otherwise provided prior to issuance of building permits. An agreement shall be processed and recorded pursuant to Section 21.44.160(4)(d)(iii) of the Carlsbad Municipal Code. Said agreement shall provide for mutual easements for parking purposes and shall further provide that said easements cannot be removed or modified without the consent of the City of Carlsbad. The developer shall not restrict the use of the on- site parking spaces without approval of the City. 19) 20) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. The grading for this project is defined as "controlled grading' by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to insure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 11.06 of the Carlsbad Municipal Code. 21) 22) No grading shall occur outside the limits of the subdivision unless a letter of permission is obtained from the owners of the affected properties. Prior'to the issuance of a grading permit, the haul route shal. be submitted for review and approved by the City Engineer. The developer shall obtain approval of the plans from the City Engineer and pay all associated fees and performance guarantees prior to issuance of any Building Permit. The developer shall install said improvements to the satisfaction of the City Engineer prior to the issuance of a Certificate of Occupancy or occupancy of any portion of the project for any purpose. To wit: a) Half-street improvements for the easterly side of Carlsbad Boulevard, plus full median strip improvements, from Elm Avenue to Grand Avenue. Developer will bond for or pay City half cost of installation of full median strip from Elm to Grand Avenues. b) Street lights. cl Street trees. d) Wheelchair ramps. e) Drainage facilities. f) Curb return at the northeasterly corner of Carlsbad and Elm Avenue. 9h; Sidewalk, and curb and gutter on Elm Avenue. Modification to the signal at the northeast corner of Elm Avenue and Carlsbad Boulevard. The developer shall dedicate a two-foot wide strip of right- of-way along the northerly side of Elm Avenue from Carlsbad Boulevard to Washington Street in accordance with City Standards. The developer shall dedicate to the City a one-foot wide strip of right-of-way along the easterly side of Carlsbad Boulevard from Grand Avenue to Elm Avenue in accordance with City Standards adjacent to the project site. The developer shall dedicate to the City a curb return area of 20-foot radius at the northeasterly corner of Elm Avenue and Carlsbad Boulevard. Land for all public streets shall be dedicated to the City prior to the issuance of any Building Permits and shall be so dedicated free and clear of all liens and encumbrances. The developer shall provide landscaped planting islands at the entrance to each surface parking area. The parking area travelled lane from Carlsbad Boulevard through the proposed entry canopy shall be one-way from Carlsbad Boulevard to the driveway exit onto Elm Avenue. Exclusive of Washington Street, which has been separately conditioned herein, all driveways shall have minimum 20 foot deep throats. The developer shall construct a direct storm drain connection with the Central Business District Storm Drain to the satisfaction of the City Engineer. The consolidation shall be completed in accordance with City procedures prior to the issuance of any Building Permit. The developer shall design and construct the westerly driveway on Elm Avenue so as to allow right hand turns only exiting the project. The geometry of the driveway shall be such as to allow the exiting turn to not encroach on the southerly west- bound lane. Any off-site parking area shall be designed in accordance with City Standards and to the satisfaction of the City Engineer.
